This is my theory. They're not family/friends. They are individuals trying to justify that speeding (and in particular excessive speeding) are ok, and that it is the fault of OTHERS that don't defer to their speed if something goes wrong.

No one said the BMW driver isn’t at fault.

Yes actually they have. Repeatedly over the last 48 pages. Read the thread.

You probably misread. Nobody said that.

Nope. You just jumped in at the end of the thread. There have been repeated posts about an old 4Runner causing the accident and was probably just someone looking for a payout. If you don’t want to read the whole thread - cool. But don’t jump in with false claims.

I’ve been reading the whole thread. No one was solely blaming the 4Runner.

Yes, someone was doing exactly that

I mentioned a few pages ago that I was in an accident years ago where a speeding car hit me and I was told I was at fault because the other car had right of way.

I never said the bmw was not at fault.

There is more than one poster who thinks the 4Runner is partly at fault. I wasn’t there and only read on here so I can’t say.

What are you talking about? No one was talking about your post.

The posts only blaming the 4Runner started at the beginning of this thread. 50+ pages ago.

Nope not true. There are many many posts about how the 4Runner is partially responsible. Because he is. Go back a couple pages...lots of folks agree. He should have waited for the road to be clear instead of playing chicken with a speeding car.

Were you there at the scene to witness the accident and therefore know the Toyota was able to see the BMW when they started to turn? If not, you are wholly speculating because you want to blame someone other than the BMW driver for his unconscionable choice that killed two girls and may have permanently disabled a third.

No one is “absolving” the BMW driver.

I didn’t say anyone was. But you were not at the scene of the accident and you don’t know the Toyota was in any way at fault here.

I am the one who said I got into an accident turning and could not see the speeding car. It is decades later and I still think I did nothing wrong turning unable to see a speeding car. Yet, the police and insurance said it was my fault.

If there were no pedestrians present and this was just your everyday accident and the cops came after the fact, the cops would not put the bmw driver in jail.

That does not mean I feel don’t feel sympathy for the grieving families.

Seems like 4Tunner guy/friends are on this forum and fighting tooth and nail to blame BMW speeding as the only reason. I think both the parties share the blame. If 4Runner turned without right of way, it shares bigger blame as it enabled the whole thing.

Did your accident happen in Virginia?

How do you know the BMW was visible when the Toyota started its turn? All we know from the police is that the BMW was driving at an excessive rate of speed, nothing about any fault on the part of the Toyota.

Horrible. There was another vehicular fatality in Oakton involving an 18 year old driver. Note this is a separate news story:

PP re: Oakton crash @ Fox Mill.

Just wait. In this case, the longer it takes, the more thoroughly investigated. FCPD knows that all eyes are on their investigation and they are especially accountable to the victims’ families and survivors. Call me naive, but this “quiet” means that FCPD and law enforcement is building a rock solid case. Of course the BMW driver’s family is lawyering up and plotting their next move…

It is also very likely that the BMW driver had been offered a plea deal. If so, they most likely won’t announce anything until the agreement has been finalized.

I would hope not! If he’s charged with a felony, any college should rescind admission. Plus, he should be serving time in the fall. Although he hasn’t been arraigned yet. Or even had his name released that I’ve seen. I’ve lived in Oakton long enough to know that unless he lives in the townhouses, he won’t even get a ticket. Different set of rules for the rich. Betcha they Brock. Turner this “promising you man, with his whole future ahead of him”. Disgusting. Not like the freshman girls get a future.

Read up here on how this works before you freak out that there is no arrest yet.

Dude - your backyard kangaroo court can distribute blame based on your rule book.

The law that counts - Virginia’ law - is pretty clear. If the BMW was speeding excessively, he gets 100% of the blame and it doesn’t matter what the 4Runner did. If the BMW wasn’t speeding excessively - all your scenarios come into play. If the BMW driver was impaired, that a whole new level of trouble for him.

It don’t matter if the 18 year old was a stellar student and was running a 3.5, had a great life ahead of him and spent his weekends volunteering at Senior Living communities. It really does not matter.

Yeah those freshman girls were not part of his class, so are discounted.

We don’t know for sure but just from photos it sure looks his actions played a role.

Looks like both drivers made mistakes here.
