And you both want to ignore the fact, brought up repeatedly earlier in the thread with the specific law cited, that excessive speed negates certain rights of way. The teen driver's excessive speed (exact speed still be be proven but witnesses clearly said it was extreme) is very possibly going to negate any right of way violation the Toyota driver might have committed. But the investigation, not your speculation or mine, will determine that.

Nope not true. There are many many posts about how the 4Runner is partially responsible. Because he is. Go back a couple pages...lots of folks agree. He should have waited for the road to be clear instead of playing chicken with a speeding car.

I am not going to go back and real all 50 pages but I know I posted that *I* was at fault when I was turning and another car was speeding and hit me. That is why I wrote above that I never said bmw was not at fault. I’m pretty sure it was my post.

Like many others, I think the 4Runner may be partly at fault but in no way would the bmw not be at fault.

Were you there at the scene to witness the accident and therefore know the Toyota was able to see the BMW when they started to turn? If not, you are wholly speculating because you want to blame someone other than the BMW driver for his unconscionable choice that killed two girls and may have permanently disabled a third.

No, POS. If he hadn’t been driving like a bat out of hell, this would have been nothing more than a property damage claim, and no one would have died. Their deaths are solely on him.

If you want to blame the Toyota driver for his at worst property damage contribution, so be it. But do not equate property damage with the loss of human lives. It’s sick.
