I think if this goes to trial he gets reckless driving but not manslaughter. The fact that the other car caused the accident is a compelling defense against manslaughter charge.
Hopefully prosecutor is offering less than one year in jail as a plea deal. |

If the 4Runner driver was blind. Every single person on this forum can tell whether a car is speeding towards them or not. It's simple vision. |

It will only go to trial if they have some sort of excuse. The defendant will plead to m/s and will serve five years on each charge served concurrently. There may be other charges. If he doesn’t plead, the prosecution will crucify him. The other driver will appear as a very sympathetic witness. Hopefully, the defendant’s surviving victim will not need to testify. |

18.2-36.1. Certain conduct punishable as involuntary manslaughter. A. Any person who, as a result of driving under the influence in violation of clause (ii), (iii), or (iv) of § 18.2-266 or any local ordinance substantially similar thereto unintentionally causes the death of another person, shall be guilty of involuntary manslaughter. B. If, in addition, the conduct of the defendant was so gross, wanton and culpable as to show a reckless disregard for human life, he shall be guilty of aggravated involuntary manslaughter, a felony punishable by a term of imprisonment of not less than one nor more than 20 years, one year of which shall be a mandatory minimum term of imprisonment. C. The provisions of this section shall not preclude prosecution under any other homicide statute. This section shall not preclude any other revocation or suspension required by law. The driver's license of any person convicted under this section shall be revoked pursuant to subsection B of § 46.2-391 Yep, looks like the right charges were filed. |
A compelling defense? No. He will not have a defense. His best shot is to try to plead it down. Because he is guilty. The end. |
By driving recklessly at more than 45 mph over the posted limit, the BMW driver is solely responsible for the deaths of two children. He is also responsible for destroying the lives of his surviving victims and the people who were in his car at the time he killed the girls. And all the families, including his own. That’s the reality. You can refuse to face it but you cannot change it. |
Far from facing prosecution, the Toyota driver is actually a victim in this accident. |

Isn’t that worse? He was already in the intersection so he wasn’t even turning and not seeing the speeding bmw. The bmw is of course at fault but I still think the 4 runner is partly responsible. It is such a huge pet peeve of mine when cars are sticking out. They aren’t going. They are stopped partly in the lane. Was it a pedestrian crosswalk? I admit I am not familiar with this road. I’m just trying to understand this terrible tragedy. |
