I agree with he doesn't need to be shot yet, however where do you draw the line? Would you be ok with someone moving into your house and using your facilities and eating your food, as long as they are "not hurting you", and that would be ok? If they can be shooed away without violence, then fine.

Start with s motion activated light. It sounds like your yard has the right conditions for sleeping, so make it less comfortable. If you can afford it, a ring camera.

It may sound silly, but I think it also helps to have some no trespassing signs. It gives the signal that you know he was there and will call the cops.
