I thought this also. I know him and he isn't this stupid. Does he yell? Yes, I have heard it. But I have a difficult time believing he would intentionally hurt a student, especially in a room with a camera and where there were a lot of other students around. It just doesn't make sense.

If the child was sitting (which they were), with their legs and feet out, and Winter was standing very close to the child, it's possible that he himself was throwing a tantrum while being angry, and stomped his foot, accidentally making contact with the child's foot. I could see him stomping his foot as he yells. I know he yells a lot - my kid had him at Barnsley.

So, in that case, there's no intent, but, it still seems ridiculous for Winter to be stomping his foot in anger, like a petulant child.

At best, he will be fired, with a misdemeanor charge. At worst, a felony second degree assault charge.


There is no such thing in Maryland as a "felony second degree assault charge." Second degree assault is a misdemeanor, albeit one that carries potentially ten years in jail. Slapping someone and beating them quite badly can both be the misdemeanor of second degree assault. Unless he stomped the foot badly enough that it was permanently impaired or lost (which seems exceedingly unlikely), there's no possible felony assault here.

I could also imagine potential charges of child abuse or endangering a child here as well

The AP called the police because her husband is the school resource officer for the school. She should have followed protocol and reported it to CPS instead of calling her husband.


Exactly this. It's not MCPS protocol to immediately call the police for something like this. This sounds like it was a personal vendetta against him. She needs to be investigated as well.

Actually, I believe it is MCPS policy to report any witnessed crimes to the police. There is also an obligation to report suspected or witnessed abuse to CPS. Note the difference between suspected and witnessed. What a crime is witnessed, there is almost certainly universal requirement for the personnel to report it to the police. This is why MCPS Policy requires calling the police when there are weapons or drugs. In other words, crimes must be reported to the police.

I don’t think he was stomping in anger. I think he was showing the child that stomping isn’t a good idea. I might assume the child stomped on another kid’s foot. Just speculation!

He has a horrible temper. My child is no longer in the school, but when he was, he was terrified of Mr. Winter after Mr. Winter threw a temper tantrum and threatened collective punishment against a wide group because he could not figure out who the actual person was That had caused a problem

Why is it so hard to believe that someone with a temper would escalate to stomping?

I get the complaints that kids are non-compliant and parents are clueless, but that doesn’t excuse stomping on a kid’s foot!

If the kid just listened to the principal, he wouldn’t have had to assault the kid?!? Seriously?

Interesting to read this thread and see teachers swooping in to defend this criminal. And now blaming parents and saying how awful they are. My kids are grown now and did not attend MCPS for this very reason. Teachers at MCPS tend to be very entitled most likely due to their union association. The us and them mentality is so bureaucratic and typical of pubic school teachers. This post is the perfect illustration of teachers acting entitled!

You’re a lunatic. There is absolutely no excuse for what he did. You probably abuse your kids too based off your idea of acceptable behavior for an adult toward a child. I seriously hope you don’t have contact with children in your job.
