Rarely does a judge grant a motion to acquit without the defense presenting a case. It was thrown out because there was no clear evidence.

Judge Burrell was very clear that the burden of proof even if viewed in a favorable light simply did not meet any level to continue the trial or eventually find him guilty.

It doesn't sound criminal but it sounds very inappropiate.

Granting a motion for judgment of acquittal is a pretty strong statement that the state had absolutely no case OR that the witnesses who they called lacked any credibility.

As a prior poster said, judgments of acquittal are very, very rare.

I don’t know anything about a post regarding a field trip. Collective punishment is a violation of MCPS policy. It actually caused harm and violated an IEP/504, which I can’t discuss here. He had to apologize after the incident because it was exceptionally inappropriate how much he flew off the handle and berated children who didn’t even have anything to do with the bathroom issue. We know the custodian, and he doesn’t appreciate children being screamed at and threatened. Virtually nobody in that building liked Mr. Winter. He treated staff poorly, micromanaging them constantly. He made everything about him, especially anything around Maryland day. Sole parents absolutely loved him, but others hated him. He did communicate often as a good aspect.

While I am not sure of this incident, I worked with and for Mr. Winter for several years and the generalization that nobody in the building liked him is so off base! I know many many staff who liked working with him. I agree he was a fantastic communicator and could be loud at times but he cared more than any principal I have had over my 20 plus year career. What’s happened to him was a rush to judgment after Biedleman and very sad as he (Winter) deserved much better.

Agree with this completely! We have kids at Barnsley and there were issues with kids vandalizing the bathrooms. The new principal made the custodial staff go around from room to room telling students why they shouldn't vandalize the restrooms. Honestly, I found that more inappropriate. It's not the custodian's job to get kids to behave. That falls on the principal.

If your kid is in MS, it sounds like you have no idea how bad things have gotten at Barnsley since Mr. Winter left. The behavior of the kids is just terrible. This year has been miserable for all involved - staff, students, parents. We had a good, qualified, capable teacher leave mid-year because the kids were just a mess and admin was not supportive at all. At least Winter had a handle on student behavior and made an effort to be present and support his staff as well as he could within the limits of MCPS.

So your kid went from Barnsley to Wood MS. There are most definitely policies in place that punish all the children, especially regarding bathroom access. These have been implemented as a direct result of students vaping/smoking weed/fighting the bathrooms.
