Before you mention TPS (which expires 9/2026), TPS is ONLY for aliens who are present in the USA; TPS cannot be substituted for a visa and TPS is not available for aliens outside the USA.

Practically: in what legal manner can Garcia be brought into the USA? (even assuming his country lets him go).

As the right wing judge on the 4th circuit put it, this case is just about the principle that you don’t get to illegally kidnap people from the US and then claim they lack any rights because they are outside the US.

They did not illegally kidnap anyone from the US. There was nothing wrong with picking this guy up and sending him out of the US. No 'due process' was required to do this. The only mistake is sending him to El Salvador because of his withholding of removal.

His wife simply needs to move to El Salvador and hope for his release there, where they can live in peace in his country.

No, he's much too notorious now for USCIS to not do their due diligence. BTW, USCIS is incredibly thorough, in case you didn't know. Very little gets past them. Hence why applications take years to move - there's someone examining your entire life under an electron microscope.

This gentleman being held in El Salvador’s wife was interviewed by Michael Strahan on ABC today and he asked her if she was in fear of her husband and she would not answer. A girl's body was found along the C&O Canal in the vicinity of Chain Bridge a few years ago. She was Hispanic. Her body had been cut up into pieces. A young man was also found murdered and dismembered along the C&O Canal a few years ago. Law enforcement found MS-13 insignia in the woods close to where this young man's body was found. Any reasonable person with their head screwed on straight understands the animals who committed these crimes do not belong in our communities.

MS-13 is a murderous gang known for drug dealing and human trafficking. The manner in which the two above young people were murdered indicates at the very least extreme psychopathy. They are a public menace.

I am not happy with a lot of Trump's actions, but deporting brutal gang members should not disturb anyone.
