My constitutional rights have been violated and I want to sue.

Anonymous wrote:OP, unfortunately the law is not on your side. In 1905 when facing the smallpox epidemic, a pastor in Massachusetts, Henning Jacobson refused to get a smallpox vaccine. The case made it all the way to the Supreme Court. And SCOTUS ruled:

Jacobson vs Massachusetts wrote:“Upon the principle of self-defense, of paramount necessity, a community has the right to protect itself against an epidemic of disease which threatens the safety of its members.”

And it allowed the state of Massachusetts to force Pastor Jacobson to have a smallpox vaccine in order to ensure the safety of the community from an epidemic. This is considered settled law and judicial precedent. Based on that, you could try to sue the state governments which are enforcing the stay-at-home orders, but no judge or court will take your suit seriously or contradict the SCOTUS ruling. You would have to appeal this ruling all the way to the Supreme Court and hope that the current sitting court decides that the precedent was wrong. It is pretty unlikely. It sounds like you would just be tossing a whole lot of money out the window to lawyers. If you plan to do that, why don't you just give me $100K. I've told you the same result you'll get and have saved you months/years of time.

Cuomo threatened to sue the entire state of Rhode Island over their quarantine measures.

Anyone know what legal theory he planned to base the suit on?

This article gives a pretty good description of the gray area between restricting rights vs protection of the community health.

I'm at my wits end being told that I cannot visit friends and family who want to visit me, being told what I can and cannot buy, being told what stores need to be closed and what can be open, being told what I have to wear to leave my house. I feel like I live in a dictatorship. I have $$$ and want to sue with a good attorney who can get attorneys fees and damages for this garbage.

Mom? Is that you? I told you I'd come visit when this is over.

What? Doesn't matter if you personally signed it or not. Ever heard of the term, social contract? Our Constitution is still living, albeit on life support these days...

Let me tell you what SHOULD happen with you, OP

When you go find some lawyer to represent you, they’ll call the police and give them your info. Then a police swat team should crash into your house in the middle of the night and drag you out into street in your underwear. Then they’ll hogtie your and haul you to some basement somewhere where they’ll spend a few days beating you all over with a rubber hose. If you survive that, you can get thrown in a dank cell with no bed, no toilet and no light. You can spend a couple months there while you think about how much of a disgrace you are.

where in the Constitution does it say you have the right to avoid taking protective health measures during a pandemic?

No constitutional guarantee that a person can contract and spread Covid19 if they want.

Michigan is out of control; their governor is out of her mind and drunk on power.

I am from Michigan and totally support the Governor. Michigan has one of the fastest growing case rates in the U.S. Hospitals and Hospital workers are overwhelmed. Michigan is one of the most obese states in the union, and people there are generally unhealthy. I have family members with preexisting conditions, family members over 80 and family members in nursing homes in Michigan. We’re starting to see from New York that drastic measures pay off. NYC is flattening faster that other parts of the state. I personally think it’s better to frontload the pain rather than to take measures that would only increase and prolong the spread. More than 44,000 people died in only a matter of weeks.
