So it's not It Ends With Us, which means it's not Ryan or Blake or anyone else whose only project with Wayfarer was It Ends With Us. And again, the declarant is the one who is alleging Sarowitz made that comment about destroying Blake and Ryan that references Hamas. This person is described as a third-party. If the statement was made directly to Ryan, we would know about it by now. |
Someone on Reddit thinks it’s a WME exec. I tend to agree. Billionaires aren’t taking meetings with random people. And if Sarowitz did make the hamas comment to this person, he likely mistook them for an ally or at least a neutral party. But as we’ve seen throughout this litigation, when backed in a corner the elites have taken BL and RR’s side as the perceived more powerful group. |
I read that theory. I disagree with their conclusion because I don't think a WME exec would be able to ask that Baldoni or "his associates" not visit the set of a Wayfarer production. I think it has to be a director, high level producer (not just an executive producer), or well known star of the production, anyone else and that doesn't make sense. I likewise don't think Sarowitz would be requesting a 1:1 meeting with some WME exec. It would have to be Ari Emmanuel himself. But again, I don't think it can be Ari because there's no other Wayfarer project that Ari was personally involved with at the level of being able to make demands on set. Yes, some of their other projects at WME talent. But not anyone at Ari's level. I do agree with that person that whoever the declarant is, they must have a history and good relationship with either Ryan or Blake. I think this for two reasons: 1) The declaration makes it sound like Sarowitz arranged that 1:1 meeting specifically to tell the declarant that Ryan and Blake better back off or else. It only makes sense to do that if the declarant has the kind of relationship with them to deliver that message. 2) The declarant obviously went and told Ryan and Blake what Sarowitz said, but not in a "hey guys, back off, this guy is serious" way, but rather in a way that allows Ryan and Blake to use it against Sarowitz. And this person appears to be ready to testify for Blake. So yes, definitely someone associated with them in some way. |

NAG’s take on the redacted affidavit and how it demonstrates the paucity of the Lively case. First she agrees with others here no legal basis for the redaction of the declarant’s name. Second, she attacks Lively’s assertion that this person will testify at trial because evidence of “verbal abuse” on another set is not admissible. My take on it is the declaration is being submitted as evidence of Sarowitz making the statement about wanting to destroy Lively. That goes to what is relevant to the motion for attorney's fees, which is that the lawsuit was filed to silence/punish someone making an accusation of SH and retaliation. The 47.1 motion I thought was fine, nothing groundbreaking there that we hadn't seen and basically what was expected, but well put together. And Lively is lucky that the Wayfarer parties, and their counsel, are extremely stupid and wrote and said a lot of things that imply the intent of the lawsuit was punitive or for PR reasons moreso than based on grounds to believe they had a winning legal case.
And then I think, since that declarant was going to make a declaration about that relevant information about Sarowitz and also had negative experiences with Baldoni, they threw that irrelevant info in there, unredacted of course, just cause they could and it would make it into the press. It doesn't mean the info about Baldoni's alleged verbal abuse will make it before the jury, it was just kind of a cheap shot that Lively threw in there. I was wondering why the 47.1 motion came out now, since Lively is still collecting evidence from Wayfarer (which, we may wonder, could be some of the most damaging evidence since Wayfarer has not turned it over, so why not wait?). There was some speculation they dropped it because Eleanor the Great had its Cannes Premiere, and that seems to be as good a theory as any. |

Makes even less sense because, again, this person worked on a Wayfarer project UNRELATED to IEWU. Sony is the only project Wayfarer has coordinated with Sony on. So there would be no reason for a Sony exec to be on any other set, and if they were, they certainly wouldn't have the pull to demand Baldoni, and actual producer, stay off the set. |
