Jogger Chased and Shot

I always poke around construction sites in my neighborhood- I love seeing the floor plans, etc. No harm in this and it's pretty common.

Someone posted the letter filed by the DA on Reddit; looks like the DA attributes the death to a scuffle over the shotgun because the first shot went through Arbery’s hand.

Everyone is saying this was a trespass but frankly I think it will depend on a jury’s interpretation of the term “dwelling.” Be real here people. This was a fully formed house, just being renovated on the inside. It wasn’t a pile of dirt with a wooden frame. It is conceivable it could be a “dwelling” and thus burglary.

No the owner does. There is a rule ... if there is no victim there is no crime. There is not victim here so there was no crime.

The 3 white supremacists don't know if the owner let somebody in the house under construction. For all they knew they were chasing a friend of the owner, or a worker.

It wasn't trespassing according to the law. Also, this information will be thrown out of court. It's irrelevant.

Well, I think this needs to be put into perspective. These men felt empowered to act the way they did because the law has traditionally protected white men who kill Black men and boys. They almost got away with it! It they hadn't filmed it, or if the video hadn't been leaked, they would never have been arrested and the victim's family would have continued to scream into void without any justice.

When you are a Black man in America, there is no such thing as good enough or innocent enough.

11 year-old Tamir Rice had it coming because he had a plastic gun.

17 year-old Trayvon Martin had it coming because he fought back when followed through his neighborhood by a strange man.

22 year-old John Crawford had it coming because he picked an air rifle off the shelf at Wal Mart and carried it toward the register.

26 year-old Botham Jean had it coming because he might have smoked marijuana in his own home.

....and on and on and on. If we weren't all swimming in a racist soup, then the murderers might have felt a little less empowered to shoot to kill, and they would have come to justice much sooner.

Yes, times a infinity

But, we're literally talking to a wall. There are people on this thread who will never understand how racist they are.

Some property owners wouldn’t want you trespassing, you know.

You are very clearly not a lawyer that practices criminal law.

That is very interesting.

People here really need to stop calling everyone a racist who does not agree with them that this was some kind of KKK execution. Many people are just saying they don’t have all the facts or pointing out that Arbery may not be the choirboy some people want him to be. That’s okay. A jury can still find the McMichaels guilty of murder if that’s what they think the facts show. Drug dealers are murdered all the time and they are obviously not the ideal victim, but their killers are still found guilty.

An opinion that Arbery was not simply a jogger is not the same as an opinion that the McMichaels are innocent.

Also regarding the burglary aspect, I think it can turn on whether the home in question can be defined as a “dwelling.” I’m sure there is Georgia case law on that. It’s obviously a fully built home on the outside, just gutted and being renovated on the inside. It is a nuance of the law that could bring felony burglary into play. No, I am not saying the McMichaels witnessed it either. Just saying it could be viewed as a burglary depending on how that word in the statute is interpreted.

White Christian males brought guns to chase down a young man.

First they lied that they owned the property. Then they lied again.

Yeah, I'm with team guy who died. He's the victim.

No it's not his fault he tried to take the gun. No it's not his fault he's a victim. No his past in this case isn't the issue.

What is the issue is that White Christian Males decided to do something dum. Then again their intelligence level has to be the size of a nat. Anyone who sides with them is also a complete moron.

1. Do some research. Under GA he was not trespassing

2. Some of us find it vile that others are making shit up about a young man who was killed in cold blood by redneck vigilantes. Victim blaming is disgusting. There is NO evidence whatsoever that he did anything wrong let alone was “a bad person”. Why are you so intent on continuing with this false narrative?

So it's the victims fault?

No no no. The murders didn't own the property. Came with guns to what? They were not the police. This is a no brainer. They go to jail period.

Agree with this 100%. These murderers are NOT justified in any way for taking the law into their own hands. They definitely should go to jail. And there was more than likely a RACIST element in their setting out on a vigilante mission because they assumed that black tresspasser was up to no good. (I say that because I am not AT ALL convinced they would have taken the same reckless gun-toting action if the dude had been white.)

What I am also not convinced of is that they are randomly hunting black joggers for sport.

Posting again because this gives the exact laws and reasons the DA didn’t arrest them after watching the video: the DA’s office is saying that McMichael was acting fully in self-defense, because Arbery ran past them, returned and attempted to pull the gun away from the McMichael. There is a scuffle and the DA says Arbery punches McMichael and is shot in the hand (from holding the barrel of the gun). It then says Arbery initiated the fight, which by Georgia law allows McMichael to use deadly force in defending himself, which is the crucial part that will have to be argued in court. Then they say something about Arbery’s mental health records and prior convictions as evidence of aggression.

None of this exonerates the McMichaels, it just gives insight as to WHY they didn’t arrest them in the first place.

That is the problem. This thread is full of people who view African Americans as being victims and will then play the game of twisting things to support their "team." Didn't we learn from previous cases that these encounters are rarely black and white?

It's kind of ironic because cops tend to do the same thing.

Have you noticed that any poster who brings up the fact that the jogger charged at the guy with the shotgun is called a racist. This is a key point because it is very difficult to fight someone that is trying to take a long gun. Your option at that point for an untrained person is to shoot the person or be killed by the person attempting to take your rifle. Ultimately, I hope these guys will be judged by their horrible judgement preceding the shooting.

You do realize the DA is full of poop?? That account was based solely on the shooters account. The DA frames the narrative in order to give the shooters a pass.
