So the state allows someone to decide for themselves who is and is not a criminal, decide to try to "arrest" that person, then shoot and kill that person when they try to defend themselves? Then the state basically allows lynching.

Imagine for a moment 3 armed black men pursue a white man jogging in his neighborhood, attempt to restrain him, then shoot him dead when he resists. Would those black men be in jail for murder? Would we be asking about what the white man was wearing? Where he was going? Or what crimes he'd committed in life as justification for his murder?
