There’s a long article that says they are waiting for the bmw data to show how fast he was going on inspect

Here’s an important part of that article:

“Police said it is possible there are still witnesses or people with images of the crash who have not come forward yet. Anyone with any information that might help their investigation is asked to call 703-280-0543.”

The Toyota driver could have been the big enabler here. While the kid driving at high speed was wrong, if he had turned left from Sutton to Blake, there is hardly 1000Ft or so of distance before it reaches Five Oaks road. If the BMW had right of way, then the adult Toyota caused the massive accident.....investigators should look into this angle too.

Nooooo! I must believe that Toyota driver was attentive and allowed the girls to clear the crosswalk or slowed when he saw them.

In that case you are a sitting duck and Toyota drivers attention was rightfully on the pedestrians and not a car barrel king towards him at 80-100 mph. We’re talking seconds. Seconds.

Someone upthread posted (with citation) that if you're speeding you lose the right of way.

Letting girls pass is one thing, and not following right of way is another. I live there and I know very well that left turn is Blinking Yellow most of time. The BMW might have been at high speed, it couldn't have gathered that much speed after turning left on Blake in 1000Ft distance. Blaring horn could cause people to imagine a speed of 50Miles/hr as 80Miles/hr. Let the investigators decide. But my gut feeling says that Toyota should have waited for clear incoming traffic road OR next signal change.

Kid has a rolling start on Sutton for sure.

He was already going pretty fast on Sutton, probably to beat the red right.

The 1000 feet distance doesn’t matter if the BMW kept accelerating after the turn.

Look at the damage on the Toyota, it absorbed most of the crash energy.

The Toyota saved the BMW driver’s life. The BMW crash absorption is probably the worst of any car I have seen in recent memory.

The BMW pedestrian crash protection was also non-existent. Garbage German car.

How can a guy trying to make left on Right Of way road decide on speed of incoming car? The car speeding must get tickets, but the car making left and causing this situation (not intended by any party) has a big hand in this accident.

I disagree....had the Toyota waited for it's turn, regardless of the speed of BMW, no accident would have happened.

...and on the other hand, regardless of the speed of BMW, if Toyota turned left without following Right Of Way rule, accident would have been damaging to similar level as girls were too close on the walkway. A non speeding 45Miles/Hr could have caused similar carnage....

Not kids friend here...live pretty close to that area....just saying that we can't box ourselves with just speed being the factor. I see people speeding all the time....not the right thing, but true.

That may be the driving rules in Pakistan, but you will find out real soon from the Fairfax Police that’s not how it works in the states.

Again (and again), no charges have yet been filed. But looking at what has been described -
1) The Toyota was making a left and yielded to the pedestrians crossing who have the right of way.
2) In stopping to let the pedestrians cross, the Toyota may have blocked oncoming traffic.
3) Only the BMW hit the Toyota, so there did not seem to be any other oncoming traffic that was impacted.
4) If the BMW was speeding, the Toyota likely started the turn while the intersection/road was clear.
5) If the BMW was speeding, the driver loses the ability to claim the Toyota caused the accident as per Virginia law.

I'm having a hard time imagining that no one else here has ever been in a similar situation - you start making a left turn while the opposing traffic is clear, and then need to yield to crossing pedestrians that have the right of way. Heck, it happens to me when I'm turning into my driveway! Anyway, the charges should tell the story.
