My husband is insisting I file a police report, and I most likely will later today, to keep the peace in my home. But my gut tells me there is likely to be little the police can do at this point, especially if the video is gone, which, I guess, is probably the best I can hope for at this point.
Really wish my friend had kept quiet to her husband about what she found, but I can't fault her either. She's not in the best emotional state right now, as she has learned other damaging details about her husband this week- unknown credit card debt, withdrawals from savings accounts, not paying for his kids medical bills, etc.
Sigh. Can't sleep. And yesterday started as such a happy day; DH and I finally got to hear our baby's heartbeat, and FTS went well....

Does everyone take comfort from the fact that they don't know the faceless NSA analyst watching their private smartphone/IPad recordings?

NSA's motto is "collect it all." They have storage capabilities that are essentially "bottomless."

They really do: collect. it. all. It doesn't matter that you think you haven't done anything wrong; that you don't think you have anything to hide:

-did OP have something to "hide?"

The Patriot Act mandates your cell phone allow the authorities to turn it on and record you without your knowledge or consent; why would anyone think they don't do that already? Why would they make an exception to "collect it all" for your IPad/smartphone?

Open your eyes if you are outraged by what happened to OP. It is happening to you every day.

OP unless he's a serious techy, the video isn't completely gone from the hard drive and the police can recover. Call the, file a report, and get a lawyer. Do not communicate with the POS, if he attempts to contact you give him the name/number of your lawyer and tell him to go through them. Save yourself the aggravation.

OP I may be in the minority here, but I'd back away and let this drop if/until you need to do something. Sure, file a report, or whatever gives you/your husband closure. But I agree with PPs that you want nothing to do with this whole ugly situation, especially in the beginning of your second trimester. Friend's situation is tragic but that's unfortunately her mess to handle. I'm not normally that hands-off with close friends but marital disputes like this are sink holes of drama. Focus on your own family, and congratulations on your baby to come. Sorry this happened to you.

I totally agree that this happens everyday as I inow a few people who do this for a living. But what op is going through is totally different.

OP here- thanks to all who have provided useful information.

I will be filing a police report today. Friend moved out her home with her husband last night and filed paperwork for divorce yesterday. She decided to tell me about the video after first consulting with her lawyer.

I talk to her this morning to get a little clarification before making my decision to file a report. She found the video in an email in folder in a yahoo account. Which tells me he recorded the video, then sent it to himself... to do what, I'm not sure. Distribute? Personal use? I have no idea. And let it suffice that the the "explaination" for how the husband says it accidentially happened does not come anywhere close to adding up. Anywhere, clearly the original recording exists somewhere, in addition to the copy my friend came across in the email account. Even if she deleted the email, it can be recovered.

Other than that, I am staying out of their drama. Again, thank you to those who have provided useful advice.

And yes.. this is nothing but drama. And it continues. Now the guy is tell my friend this morning he will give up his passwords to all his email accounts, etc., if only I won't file a police report. He knows he screwed up and is doing everything he can to save himself... its so pathetic.

Guess what? That ship has sailed. I already called the police to file a report. Just waiting for a call back now...

Guess I am just venting now. This is so ridiculous. And I'm suppose to be working and preparing to tell my boss I'm pregnant this afternoon...

I'm glad you filed the report. Now you need to try to distance yourself from the drama and just deal with what is.

Congratulations on your healthy pregnancy. Try to focus on that little boy or girl. You're in the second trimester! Go back bin your mind to the appointment where you heard the heartbeat and try to just focus on that feeling. You've done what you can do by filing the police report.

He probably parked it there for free storage.
I'd imagine this might being it under the auspices of the FBI, though - moving things through email servers usually involves crossing state lines. Who knows if he shared it?
You're doing the right thing. Stay cool and calm. Hand it over to the police/FBI and let them handle it. This guy is sick and needs to be stopped.
