Things that are illegal:

1. Having a fake ID.
2. Having sexual contact with somebody who is below the age of consent.

Would you want your son to be in the position of having to tell the police, his lawyer (that you're paying for), and the judge that he thought she was of age because she showed him her fake ID? You know, and I know, and everybody knows, that high school kids like to try to go to college parties. Therefore, it is prudent for a college student at a college party to be prepared for the possibility that a party-goer is a high school student.

This is an entirely separate issue from a fake ID -- and by the way, I think that society generally agrees that people shouldn't have fake IDs. There aren't a lot of arguments about how the line between fake ID and real ID is so gray and nebulous and people can't possibly be expected to have to figure it out.
