No it's not. The words in the Op Ed are what is referred to in the law as "defamatory per se." He only has to prove the elements of defamation, not damages. If he proves defamation per se, damage to reputation is presumed but he still has to prove the extent of that harm to support his damages claim, and the presumption of harm can be rebutted. It was seen as inappropriate because Ms Heard was at the receiving end of it. Criticism coming from someone who thinks Elaine was "tireless and unshakable" is just laughable. Elaine sometimes has nothing to say so she resorts to insulting witnesses, like the TMZ guy, she accused him of seeking his 15 min of fame or the psychologist, Dr Curry(?), she accused her of having dinner and drinks with Depp (when it was with his legal team and Depp was present) and agreeing with Depp for money. It's funny because isn't she doing the exact same thing, getting paid to present what Amber claimed as truth? I'm glad that TMZ guy called her out for it.

You can't have it both ways--if lawyers are supposed to be civil, does the same rule apply to their clients?
