Lawyer here: he can’t testify to what you’re claiming Johnny’s side wants to prove bc he doesn’t know that and the evidence is conflicting. Instead, he testified that for the bone to shatter, the tip to cut off AND the nail bed to be unbruised, he believes it was caused by a pinched force (door, drawer, etc). She was impeaching him with his deposition testimony to show he previously said under oath he has no idea how it occurred. That’s the best she can get out of him. |
Not lawyer here but I assume the conclusion to be drawn would be that it would be an impossible injury to sustain from having something thrown at him (which is how they claim AH did it right?). How could a thrown bottle shatter bone or create a 'pinched' injury? |

Of course but at some point you hit a serious case of Occam's razor. It is possible that a crazed fan dressed like AH broke into their house and leapt across the room and hammered his finger with a tiny hammer right below his nailbed and then sliced his finger! But is it plausible? |

Generally speaking, the burden of proof in civil trials is typically that a claim must be proven by a preponderance of the evidence, which means that the claim is more likely than not true based on the evidence. Depp’s complaint alleges that Heard severed his finger tip by throwing a vodka bottle. Heard’s counterclaim alleges, in part, that this claim by Depp was false. So to prove her defamation counterclaim with respect to this particular allegation, Heard needs to show that it is more likely than not that Heard did not cause his finger tip to be severed by throwing a bottle at him. She does not have to go so far as proving that it is impossible that the injury could have been caused by her throwing a bottle at him. |
I could see how a thrown bottle might crush, but not slice. It just doesn't add up. |
