The dates both have the same border around them. I think this is intentional to indicate to the court that these were defense notes - not written on the document, but on the tab. Remember these are photocopies of the evidence and if the tab flaps have been dated by the defense team, they are not "altering evidence."

Strzok has gotten his knickers in a bunch about nothing and is probably making a big deal about this to distract the public from the other evidence. Mission accomplished, at least temporarily.

If the dates are wrong, that's a problem. Sorry.

+1. Even if it was completely inadvertent, it is, in fact, misleading if those dates weren’t on the original documents. If this was an innocent error, I would expect Flynn’s team to immediately file a motion to amend their submission to correct the issue.

So Sidney Powell and Trump are discussing the Flynn case? Uh, what?

It sounds like today's hearing has been pretty wild. Sidney Powell admitted she personally updated Trump on the Flynn case on multiple occasions (after Sullivan rejected her attempt to claim executive privilege), Judge Sullivan ordered DOJ to produce all documents related to certain communications between Powell and Barr, Powell said she asked Trump not to pardon Flynn, Powell accused Sullivan of "abject bias," Sullivan asked the *prosecutors* whether, if he denied the motion to dismiss, the next step would be for Flynn to attempt to withdraw his guilty plea, and said that he'll be taking Trump's tweets about the case into consideration in making a ruling.

This is supposed to be a sentencing hearing. So before midnight tonight, Flynn should know whether he's going to prison or not, if he's still a felon or not.

Or this won't be the end, there will be another hearing later.

And whatever finally happens, it'll be appealed.

Sullivan said he'd issue a minute order on the motions he said the parties could file. No, it's not over.

Yup there’s a detailed thread on the proceedings here:

Not only did Power admit conversations with Trump, she also admitted conversations with a lawyer she claimed was in the white House, but who is actually in the Trump Campaign.

It is one big dot.

I've just caught up on the hearing. It sounds like Sullivan is probably going to give the DOJ what they're asking for.

Haha

And then courts will be inundated with defendants saying it's fine to lie to LEOs. The Department of Justice said so.

Both Sullivan and Gleeson embarrassed themselves today. Sullivan doesn't appear to know the law and Gleeson has no business trying to argue a case. He rambled, went down rabbit holes and spouted conspiracy theories. Both Mooppan and Kohl demonstrated that they have a better command of legal issues than either of the judges.

This whole sorry saga cannot be over soon enough. Kohl gave Sullivan a graceful way out. He didn't take it. His reputation is now in tatters.

Kohl did a great job. The only thing he left out were the facts. Flynn lied, it was easily provable, it was proved, and it was material. The only thing he could go with was materiality which is basically an insane argument for a defense attorney to make, let alone a prosecutor. But aside from that, Kohl did a very reasonable job of trashing the FBI and the DOJ. And Sullivan is going to have to agree with him. Prejudice is iffy though.

Yet, the agents and Comey have said they didn't think he lied. It wasn't provable and it wasn't proven. And as additional evidence came out - which was originally withheld (a violation of law), that has become even more evident.
I agree that Sullivan is prejudiced against Flynn. That was abundantly clear today.

Oh, okay. Flynn lied to Priebus, to Spicer, and others but when he talked to the FBI he just forgot.

Got it.

PS - none of Powell's exculpatory evidence is actually exculpatory. Do you know what "exculpatory" means?
