That is what decent people would do. But we are talking about Trump and his supporters. |
Just a friendly reminder:
Trump may be able to get away with defying federal judges or SCOTUS for a time. And his immunity may protect him from being prosecuted for it, but Trump's henchmen don't necessarily enjoy this privilege. Eventually, some of Trump's minions are going to be held in Contempt. Trump may pardon them, but this may go on after he is out of office. Something, something about the Arm of the Law is slow but it points to Justice. |
He wouldn't qualify to come back to the US as phoney asylum was removed from countries like El Salvador which have the safest crime rates after the crack down on gangs. The idea someone should get asylum because of local crime is wild. |
The idea that you can avoid due process by sneaking someone over the border is wild. Constitution rights can be annoying. That doesn't mean you get to skip the ones you don't like, though. |
As a Citizen of El Salvador, what rights does he have under the US Constitution? What rights do YOU have in El Salvador under their constitution? |
Why do you keep asking the same dumb question? |
You realize it's different people posting it right? Can't answer it huh? |
The Supreme Court said 9-0 to get him back here and give him due process. 9-0 |
If the Supreme Court of El Salvador ruled 9-0 to send a US Citizen to El Salvador, what power does that hold? |
Here's a question for you then? What should the remedy be if your daughter gets swept up and without being afforded due process is shipped off? What if some thug police departmentment just crashes into your house without a warrant and beats you until you confess to a crime you had nothing to do with and ships you off? |
Non-citizens have rights under our US Constitution. The Supreme Court has ruled on this many, many times. https://libertarianinstitute.org/articles/constitutional-rights-noncitizens/
https://www.pbs.org/newshour/politics/what-constitutional-rights-do-undocumented-immigrants-have <- this one is good in that it reminds us all that the US Constitution states "people" and "persons" when describing rights, it does not say "US citizens". |
Correct, IF they are currently on US soil, which he is not |
As a US citizen, we would have rights under the US Constitution. As a Non Citizen not in the USA we would have rights under our government, as he does. At this point a citizen of El Salvador is in prison in El Salvador without being charged with a crime (as far as we know), the Government of El Salvador is holding him hostage, your anger should be towards them. |
Not anymore. You are not seeing the problem. As soon as "rights" for one goes away, "rights" for all don't matter. Who is going to save you when someone just snatches you off the street and send you to the gulag? Who is giving you a phone to call a lawyer or family member? It is a slippery slope and if isn't stopped with this individual who was sent to El Salvadore without ANY due process or ANY proof of any wrongdoing, then it can happen to anyone. Oh, hey, you posted a bad tweet about Trump in 2019, off to the gulag with you. Oh, you are a registered democrat, off the the gulag with you! Who is going to stop it when the US Constitution has no more meaning? |
because he was sent away illegally without due process, so it is incumbent upon the administration to get him back and either release him, or given the the due process he is afforded under the Constitution. Anything short of that voids the Constitution as a guiding principle for our republic. |
