It depends on whether he intended to kill. To murder you must have what is called mens rea (the guilty mind) and actus reus (the guilty act). If he didnt mean to kill him, then he doesnt have the guilty mind, and therefore it isnt murder.

However, it can still be manslaughter. Manslaughter is where you have the guilty act, but not necessary the guilty mind - you may have had reckless indifference as to whether the person would die.

Because DJS does NOTHING to discipline. The state juvenile system is horrid. The recidivism rate is disgusting. The worst, though, is they know, admit, ACCEPT that they are failing these kids. But nobody gives a damn. They literally publish how poorly they're doing:

I work at Silver Oak Academy. The ONE non-state run juvenile treatment/detention center in the state.

Earlier in this thread I posted the stats directly from Dept of Justice. Men commit violent crime at about 4x the rate of women.

Yes, but women do some crazy stuff too. Have their kids kill for them, their new lover kills their ex, kill their ex's new lover, they also tend to use poison. Think of non-violent deaths and/or let's someone else do the dirty work. Those cases don't necessarily show up in the stats.
