It was a bench trial

There were no jurors.

Thanks for posting this update. Good to hear. And funny that the student is now attending Barnsley ES.

Easy answer

Pretty sure if Biedelman was harassing students, he would’ve been treated like dirt, too!

He was harassing students.

Not so funny for Winters…. Until he wins the lawsuit.

Is there a chance that he accidentally stepped on the kid's foot?

Interesting that there was a lot of details about the student- names of parents, and the behavior the kindergarten engaged in:
During the trial, several people testified that the student had difficulties staying in class for long periods and would often get up to walk around the school.

"[Judge] Burrell said the student was inconsistent in his testimony and that he showed no outward signs of pain in the video. She said the state didn’t prove whether the student was upset because his foot was stomped on or if it was because he was scared or upset about having to do something he didn’t want to do. "

Yes, this is definitely a possibility.Being at a school, I feel for our administration who have to navigate these situations. A child is running around the building, not responding to the other adults, so admin need to intervene so he is safe, and learning can continue for the other students. It can get very hectic for everyone when a student is out of control. I haven't seen the video, however, if there was a question of intentionality, then that is what the courts are for. This court acquitted him based on the facts and a video. Time to move on.

So will Winter now get another principal position in MCPS, or they'll keep him in central office, or he'll move on somewhere else?

Imagine the outrage of parents and staff if he went back to being a Principal.

We were at Barnsely ES when he was Principal there. Guy definitely had anger issues. I can understand getting frustrated with kids, for sure. I'm a yeller at home, too. But, his yelling was over the top especially for an educator.

I think he should stay in central office. IMO, he seems like he does care, but he also has some anger issues. You can't have anger issues and work with kids. The two don't go together.

Oh please. The kids are out of control now in MCPS. He did a decent/good job at Barnsley when he was principal.

Are you happier with how things are at the school now with the new principal? We had kids at the school when Mr. Winter was there and also have kids there now with the new principal.

Can you give some examples of the ‘telling’ he did that was so offensive?

The kid should not have been allowed to testify at all. Generally, kids are considered completely unable to tell the difference between truth and fiction until age 7.

It was a bench trial. No jury.

The reporting says the video clearly shows that he stomped on his foot. It seams the not-guilty verdict is because there is question about whether the on-purpose stomping caused pain!

So Winter is not guilty of assault because they can't prove he actually hurt the child. Yet he did purposefully stomp on the child's foot. He is still garbage
