guess what. they killed them. when you engage in willful, reckless behavior that can reasonably be anticipated to cause harm, you are responsible for the harm that happens regardless of your subjective intent. that’s why we have felony murder. and if you “just” intend to assault someone and they end up dead - that’s murder. |
The max they can get in DC is commitment to DCs juvenile justice agency until they are 21. That is not the same as lock up in a facility. If the agency puts them in one that’s one thing, but it’s totally up to the agency. |
Oh don't be ludicrous. The 'weapon' that killed him was the car which accelerated and he was thrown through the windshield. Maybe he took off his seatbelt to fight back or escape? Either way the taser wasn't the murder weapon. Still its absurd that this happened and I'm sorry this man died. Funny they can easily charge these girls with manslaughter for his death by vehicle on the same day but we're still waiting on murder charges from the riot on federal property 3 months ago. |
they killed him during a kidnaping. that’s 1st degree murder in DC. their subjective intent does not matter - the moment they kidnaped him they bore the responsibility for anything that happened during the event, legally and morally. this isn’t a tough case at all. there are some felony murder scenarios that are tougher (like the kid who just waits outside the convenience store and has no idea the accomplice inside will shoot.) but that is not this case. |
