A nanny work agreement and at will employment generally exist simultaneously - in fact they should.

The work agreement will outline the terms and conditions of employment, including compensation, benefits, taxation, duties, etc.

We have samples available for download at 4nannytaxes.com. We will have a PDF fillable version by 1/1/2015.

You can email Joseph@4nannytaxes.com if you would like a sample emailed to you, or call Joe at 800.626.4829.

I might turn it around and say you would love to babysit. If you stay past 11 PM you want to make sure the family understands that a car service or taxi back to your home in {location} is expected at the family's expense.

An alternative is to charge a premium hourly rate after 11 pm - maybe $10/hour more - so you are paying for it that way?

I do know it is common in NYC for families to pay a sitter's return transportation when late at night. Many nannies have this written into their work agreements, and many expect this from 9PM and later.

The key is communication - if this is something you need you need to articulate that. If the family doesn't want to agree, they are free to move on to another babysitter. Suffering silently, or bringing it up after the fact never works well for anyone.
Any payroll service can help you with your housekeeper's payroll taxes. You surely should have them done together with your nanny's because you submit all payroll on the same tax returns.

While some accountants do household payroll, most don't. Most will refer clients to household payroll services for the details.

I invite you to shop HWS - we directly compete with Care.com.

Happy Thanksgiving!

HomeWork Solutions is a national sponsor of National Nanny Training Day (and proudly so) and I assure you we SPEND money, not make money. The local NNTD organizers don't make money either - the nominal fees ~$25- 50 each cover the fee to use the venue (and local coordinators work hard to get free and reduced prices on these) as well as the cost of the food and beverages. Also many speakers donate their time but require an honorarium for their transportation costs. In NYC $40 got you hot coffee, a continental breakfast, and a box lunch with soft drink last year.

I was personally present there and the ADL's presentation on recognizing and responding to Cyberbullying alone was worth the price of admission.

Many nannies work in isolated environments, without peers or coworkers, and the opportunity to share challenges and lessons learned with other working nannies IMO is priceless. Learning, problem solving, tips and tricks are all part of NNTD.

At the risk of wading into a flame war...

And the fact the candidate is no legally eligible for work in the US makes no difference on a family's and nanny's tax obligations.

14:52 is correct.

Don't forget paid sick leave in DC
DC domestic workers accrue 1 hour of sick leave for every 87 hours worked, to a maximum of 24 hours/year

Ditto 14:21 above if the spouse is with the World Bank, IMF etc and s/he has a G-4 visa. The Dependants of the A-2/G-4 visa holder do need and EAD and also need competent income tax assistance as they don't just use the 1040EZ.
Unemployment tax is paid where the work is performed. Income taxes are paid where the worker lives.

MD, DC and VA all have reciprocity.
You are very welcome OP.
Worker's comp is commercial insurance. Homeowners and renters insurance is personal insurance. In MD it is not part of your homeowners or renters as a rider, it is a separate policy. Most agents however will only issue it if they have your other book of business because their commission is tiny and the paperwork a PITA! State Farm, Erie, Allstate, etc. are all options, any company that offers commercial insurance.
I would love a citation to the legal opinion where a part time nanny with a long-term gig was held to be a contractor. I have been in the business a long, long time and I have never known this to happen. Educate me?
OP there is a thorough discussion of this subject in our FAQs here:

MD is the correct state - she will pay income taxes where she lives. MD, DC and VA have reciprocity.
Hi OP - I am going to echo the experience advice. Past behavior is predictive of future behavior. Look for a nanny who has a work history of several years at a job, one who has previously worked with children of similar age to yours, ask behavioral interview questions (some have been previously suggested in this thread) and check references in detail.

Good luck. If the budget permits, you may have best luck using a reputable nanny agency as they have tons of experience sorting through the applicants.

The International Nanny Association also publishes a free eBook The Nanny Employer's Handbook that may be helpful?

You can get workers' comp from a commercial insurance company or through the state's injured workers fund. Commercial insurance is the cheaper route. When I lived in MoCo I purchased from Allstate, there are many other options out there. GEICO and USAA do not offer commercial insurance, you are wasting your time there.
