Yikes. If it doesn’t cover “hate speech” why even have it? It’s not there to protect innocuous speech. Threats of violence are different of course, but I didn’t see such a threat here. I saw a loony, over-stressed, wack job yelling offensively at some lady, but no actual threat of violence. And I didn’t see what came before. |

There is some USSC language that would support it being "fighting words" because it was arguably quite literally "an invitation to exchange fisticuffs." https://www.law.cornell.edu/supremecourt/text/491/397 But I am pretty sure that isn't how that has been interpreted. Bringing a case based on these circumstances is going to be very difficult. |
