Yes, but there has to be an actual law that is broken. Someone feeling threatened does not mean a crime has occurred. Md. Crim. Code 3-1001 has a provision that arguably would apply, but it seems to need more than five people to be threatened. There may be a similar provision where that wouldn't be needed. But, even ignoring the five people requirement, I'm not sure that what occurred would violate it. I didn't see 5 people on that video. And how would you know they thought he was trying to fight her? And would that place them at substantial risk of death or serious physical injury? It's easy to simply say a crime is committed, but in the real world a prosecutor would have to prove every element of a relevant statute beyond a reasonable doubt. |
