You don't have a claim against the government (probably). The importer paid the government. You paid the importer or customs broker. You need to take it up with them.

No if UPS paid the tax and got reimbursed by the customer the customer will have proof they paid the tax.


But in that case the customer did not pay the tax. It paid UPS. UPS paid the tax.


No in this example UPS paid the tariff and was reimbursed by the customer. I had this happen to me. I ordered ceramic planters. The price jumped from $120 each to $500 each. Was contacted by the shipper saying this is your new cost because of tariffs. I declined and I have no idea what happened to the items.

If I had said yes. The shipper would have paid the tariffs and I would have had to pay the additional money before the shipper would release the items.


So how is that different than a case where I buy something from a store and they include a tariff surcharge to cover their tariff cost? Does the store get the refund or do I?


You didn't pay the government so you have no claim against the government. For any refund, you would need to go and ask the retailer for a refund.

Gorsuch actually made sense in his written opinion when he basically told Congress to wake up and go back to doing their actual jobs of legislating instead of allowing one man or office from making unilateral decisions.

Trump has many ways to grift. Just yesterday he transferred $10 billion of taxpayer money to his account at the Board of Peace, an account only he controls.


First I’ve heard of this, and that’s INSANE. Why would there even be a “Board of Peace” account? Other than operating expenses, of course, which still exist even for dumb made-up entities… But even then, that should happen a different way and wouldn’t add up to anywhere near $10 billion.

PS, for anyone who hasn't been paying attention, they have been destroying our economy. Job revisions for 2025 are horrible, we have been bleeding jobs. The latest GDP report, released today, was abysmal, while PCE inflation report ran hotter than expected.

Of course now that prices go down with tariffs being removed, Trump will take the credit though it took the Supreme Court to save Trump from himself and his crappy policies.
