DP. Even with a month’s delay, this was a big loss for Musk. His primary argument for a February trial was that he would need significant discovery regarding the bot issue. By setting trial for October, McCormick implicitly indicated that she plans to allow little, if any discovery. She also stated on the record that expedition was needed because delay threatened irreparable harm, which tends to suggest she thinks Twitter’s position has merit. |

Mr. Free Speech is trying to shut down free speech again. If you haven’t seen the video of a Tesla on their auto drive plowing into a child mannequin, it’s worth a watch. This, plus the technology’s habit of steering directly into emergency vehicles suggests perhaps it needs some additional work.

Hard to see how this is a win for Musk. Biggest thing he wanted was a delay, and he didn't get it. He can call this guy as a witness, but he's unlikely going to be able to provide much evidentiary support for his claims. And even if they are true, they probably still don't add up to a breach on Twitter's part. And if this guy is on the stand, Twitter will be able to use him to knock down Musk's arguments about bots. |
