The report surely has more detail but it was prepared by defense counsel representing its client, so it must be discounted by real investigators. MoCo 360 got a copy of the Jackson Lewis contract. The contract says that Jackson Lewis was representing the BOE and working under attorney-client privilege. That report is no more credible than any report from any other defendant would be. Nice try, Silvestre and McKnight. People are going to find those emails.

For the person defending Jackson Lewis, an honest firm would have noted the timeframe its email search covered instead of just presenting a lack of evidence as exculpatory information.


I am not the one defending the firm, but I didn't interpret the statement as "exculpatory" - just that they didn't find the emails.

That said, a reputable defense firm would advise its client to retain all documents, including emails, relevant to pending investigations, given the inevitable litigation.


If your policy is to purge after 12 months, it goes a long way to making sure you don’t have many responsive documents when you get served and can no longer destroy things.

It is true but I would venture to guess somewhere on some server there are backups.


I have a hard time believing MCPS deletes all emails permanently after 1 year. It might be that users only have access to emails from a 1-year time period, but there's no way they don't store and record those for longer periods. They get sued regularly by so many individuals and entities. MCPS would never be able to defend itself from those suits if all emails within the past year were deleted.

This is why you delete things frequently. It’s easier to define yourself when you don’t have to turn over information that helps the plaintiff.

Please keep the pressure on! It has already made a difference.

This is not the only mismanaged case--it is a larger problem. Another principal was demoted this summer after 2+ years in the job that included being placed on leave several times for a total of close to 6 expensive months. Sexual harassment complaints were filed there too but he was still reassigned as an assistant principal in another school. Now he has disappeared from the directory on the MCPS website--but other administrators are still seeing him at their union office. Still being paid? Who knows?

Exactly! Anonymous people who are too chicken sh*t to come out of hiding are quick to criticize the people who have the guts to name and shame in the press.

As a MCPS employee, it would be good to know where this sexual harasser is.
