I think it was fake and he was just trying to get her not to flip on him.

Marrying her would have solved her pressing visa problem. It expired in October and could not be extended again as an au pair.

Her lawyer probably told her that she had to speak up now. Because if he was found not guilty then she flipped because he dumped her and would not marry her, CW would be screwed because of double jeopardy. And the charges against her were pretty airtight (she shot the guy even though she said he was already severely injured)
