You are assuming, first, that the info was false and, second that Sussman knew it was false. Neither of which is true. And we want folks to pass on tips to the FBI. The FBI can figure whether they have any merit.

I can only assume Garland is letting this move forward because it shows how craven the Barr DOJ was.

This is what is known as a process crime, which Rs usually dislike, and this particular one is unsupported and possibly unsupportable, since the only FBI person who received the tip is already on record as not knowing or remembering.

The judge on Sussmann’s case was a parter at Covington & Burling LLP and served on the Obama/Biden transition team as an advisor on Justice Department issues. Seems totally fair.
