It's quite damning if it's true but apparently not a single shred of evidence was attached to the lawsuit - literally NOTHING. It's all rumors still, mostly started by RP and a lot of these allegations are minor truths completely blown up to look incriminating. Also, this guy is suing GFR and RS but RS is likely covered by liability insurance so no money "won" would come from RS directly. The only money that would be "won" by the plaintiff would come from GFR directly, not RS or any board member. Good job costing GFR families MORE money with another baseless lawsuit, RP and your cronies. |

That’s not how lawsuits work - you don’t have to prove anything in your complaint. You had to have a reasonable belief that it’s true under ethical rules, but that’s it. If it was made up entirely for example the parties could be sanctioned. However the relief is so much more specific than is required that I’m sure its intentional to demonstrate what is known (and what is likely alleged elsewhere in the complaint). |

I can't forward it - It's a 33 page document. With 2 exhibits - 1 is the club bylaws, 1 is the resignation of a board member. No evidence. If it's a filed case you should be able to find it on the fairfax cty court website. |
It does not appear to have hit the FFX CTY civil cases court website yet, from what I can tell. Maybe I'm looking in the wrong place. However, since it was just filed, it might take a while before it makes its way to their public site.
In a civil suit, you only need to allege facts that support your claim. The complaint should include a short and plain statement of the claim showing that the plaintiff is entitled to relief (this follows Virginia’s version of notice pleading). The 33 page doc does this. You do not submit evidence like documents, photos, or witness testimony with the complaint itself. Evidence is presented later during the trial, specifically in discovery, pre-trial and trial. A jury trial has been requested in the Shelton civil case. |
