I talked to the Asst. Principal who was lovely. She was appalled that any teacher, even a sub, would do this and she promised to bring it up at their next staff meeting. I was really grateful to her for taking it seriously. It's the first (and hopefully, last) time I've ever contacted a school about anything like this. Um, breathe, PP. Because OP hasn't said what school system. What ACPS does may be (and probably is) vastly different from another school system in the area. I would be interested in seeing you provide some sort of validation of your references to the "ADA, the Rehab Act, and Virginia state law". |
I don't know why some teachers treat the kids like dirt...less than human. If you've got to go, you've got to go. As long as the student isn't constantly asking, I don't know why you wouldn't allow it. Be a better teacher. And a better person for that matter. |
What do you mean by "validation?" Do you mean, what law? Try checking the statutes themselves. Then check the regulations of the Virginia DOE published in the VAC. Take a look at the case law from Federal courts as well, including the extensive briefing in the California Loma Portal case. A student has a right to use the bathroom in school and any teacher or admin that says no should be individually sued. |

+1,000,000 Unless I had a student who was asking constantly during class to use the bathroom, I would ALWAYS let them go, no questions asked. I hope the teacher above has something really awful happen in his or her class. And I hope s/he has to clean it up herself. |
