He never informed her she was on speaker, he just assumed she would figure it out.

She did nothing wrong, Kanye did everything wrong so 100% it is his fault.
No speaker phone means it was not illegal as there was no illusion of privacy based on CA law.
Anyone who has ever been put on speaker knows you can tell immediately when you are on speaker. Plus, She knew she was on speaker as she was heard talking to others in the room.
