One is enshrined as a right in the Constitution so yeah, definitely more important to make sure there are fewer barriers to ensure everyone gets a chance to exercise the right to vote. DP. The argument is that to be deported to El Salvador, he was entitled to due process to determine if his 2019 claims supporting the order of protection from deportation to there still exist. Bukele claims they don't, so the question is whether Garci will get that due process, which could be as simple as a single immigration judge hearing with evidence from the El Salvador government. Assuming the hearing vacates the order, then what Bukele does with one of his own citizens is beyond the jurisdiction of US courts. Even if he is freed by Bukele, the US will likely put a permanent ban on his return to the US. |
DP. There are many Constitutional rights have "barriers" before they can be freely exercised. People have to show ID to travel on a plane, you have to show ID to buy a gun, etc.... what you consider a barrier, many consider common sense. |

No they didn't. The issue is he was deported to El Salvador, which is not allowed. Just wanting people to realize if he were deported anywhere else, there was no issue with what ICE did. No due process was denied in that alternate scenario. 'Kidnapped off the streets with no due process' appears to be the current mantra. |
Use parole. TPS. asylum, to let in millions is OK. But having them leave requires individual due process. |
