Don't know where you come up with this, but it's wrong. Racial criteria is essential for diversity which is lawful: see Fisher v. Univ. of Texas and Grutter v. Bolinger.


Have you read Fisher?

Fisher was decided on three criteria, one of which was strict scrutiny of affirmative action admissions processes (so without AA, racial criteria would be moot and illegal as it depends on it for survival),

Diversity alone cannot be a reason for racial balancing. If that were the case, we could argue that White protestants, LGBTQ, conservative students, etc etc would need proportional representation.

The court also said that there would be no judicial deference when determining whether the use of race in admissions processes is narrowly tailored. And Narrowly tailored means you don't give any Black or Hispanic the advantage of racial balancing or diversity. You have to tailor it very narrowly.

I hope Harvard loses big, but I am not holding out hope

Plan B is to fund their own AA. Hillsdale college takes not a single dime from the government. It can do what it wants without the govt oversight. Harvard should follow Hillsdale's footsteps by putting its huge endowment to good use.

Any student at Hillsdale is there on merit. Hillsdale students will defend each other's right to be there. Not so with Ivys. Ivy students call police on each other because some suspect their fellow students don't belong there.

As John Roberts said: "the way to end discrimination on the basis of race is to end discrimination on the basis of race" When you affirmatively, preferentially discriminate on the basis of race you admit students who can't do the work and you impugn the integrity of the school and its degrees. There's no reason to force Harvard to admit anyone other than those students it judges will best contribute to the institution. The government can't do this by forcing Harvard to select certain individuals because of the hue of their skin - this is a ridiculous criteria for selecting students. How many of you would choose a black doctor over a white doctor if you knew that the medical school was forced to admit students who were far inferior on tests and grades but had the approved skin color? Get the idea. Now how many smart black students want to face a life of questioning if their credentials were earned or granted by affirmative discrimination by the state. Let Harvard do what it does best (and trust Harvard doctors of any color/hue!).

They do and so I only go to Asian or White doctors.
