Fisher was decided on three criteria, one of which was [b]strict scrutiny of affirmative action admissions processes[/b] (so without AA, racial criteria would be moot and illegal as it depends on it for survival), Diversity alone cannot be a reason for racial balancing. If that were the case, we could argue that White protestants, LGBTQ, conservative students, etc etc would need proportional representation. The court also said that there would be no judicial deference when determining whether the use of race in admissions processes [b]is narrowly tailored[/b]. And Narrowly tailored means you don't give any Black or Hispanic the advantage of racial balancing or diversity. You have to tailor it very narrowly.
