You people have some weird mythology in your heads about "the President can declassify." There's a process for declassifying documents, even for the President. The process is NOT the President waving his hands and gesturing broadly, saying "I declassify this stuff' or simply willing it to be declassified with his mind. And if the process isn't followed, there is no way of knowing what is or isn't declassified and it would be chaos. If the downgrading and declassification process isn't followed or there is no evidence it was followed then it remains classified. |
The word “knowingly” is part of the code. It is an element of the crime. Biden didn’t want to be accused of willfully retaining anything, so he invited the feds to search his home and office for documents. Note the use of the word “willfully” here. Intent matters, not because it’s an excuse, but because it literally is not a crime without knowledge or intent. You may believe Biden knew they were there. Without evidence of that, where is the probable cause that a crime was committed? I suspect you are knowingly, and willfully disregarding these parts of the classified docs law, because you need reality to bend to your feelings. The law doesn’t work like that, and it’s a damn good thing for everyone that it doesn’t bend for anyone’s feelings. |
