Not statutory that a special counsel be senate confirmed. This is completely contrived by the right and the bought off judge accepted it.

This will be appealed to the 11th Circuit and overturned and this is also cause for Smith to file to have Cannon removed. This case should already have been heard by a jury.

Ken Starr was appointed under an old statute that expired in 1999. That law was allowed to expire because it gave Independent Counsel too much independent power without oversight, which was arguably abused by Ken Starr.

The current system of Special Counsels was implemented through regulation and the Special Counsel answers to the AG. It has been used in every major Special Counsel investigation since 1999 without issue regarding Constitutionality.

Mueller was Senate confirmed as the FBI director, and then resigned. He was in private practice when he was appointed as special counsel. The former FBI director has no authority to prosecute anyone.

Durham was Senate confirmed as the US Attorney for Connecticut. He resigned as US Attorney at the end of the Trump admin. The former US Attorney for Connecticut has no authority to prosecute anyone (and even when he was active the US Attorney for Connecticut cannot prosecute in VA or DC where he filed charges).

Weiss was Senate confirmed as US Attorney for Delaware. The US Attorney for Delaware has no authority to prosecute anyone in California.
