You can try and help your friend.

But remember - if you’d friend was speeding then his right of way goes away. So says Virginia law.

If he was not speeding then surely the Police will consider what you are saying. It is that simple.

The truck?

Obviously pp is talking about the BMW driver. The Toyota driver is the one that had the good sense to stop for pedestrians.

But then pull out in front of another car so…

Or did the Toyota driver pull out to make the turn when it was clear (no BMW or other southbound cars), then had to wait for pedestrians... then while he was waiting or beginning to turn, a car driven really fast came upon the intersection. See? If the Toyota was already in the intersection when it was clear, then the BMW or any other southbound cars would be required to wait for the intersection to clear (even if they had the green light).

It seems that from the get-go, there was NO talk of the Toyota driver being in the wrong. That surprised me. But, it also lead me to conclude that ALL of the witnesses must be saying the same thing --> that the Toyota driver was not at fault. The fact that the police have continued to focus squarely on the BMW driver, and not even say something more equivocal like "we're sorting it out" or "we're looking at all possibilities" -- suggests that the situation was not the Toyota driver's fault.

Unless the girls came running up at 90mph+, the Toyota would have seen the girls before pulling into the intersection and should have known not to pull into the lane of opposing traffic. The Toyota should have entered the intersection, but waited with straight wheels in his own lane to turn. Driver's Ed 101.

"Last clear chance" doctrine says that if the BMW came upon a car blocking the road, the BMW had an obligation to try to avoid the accident (i.e. STOP before hitting the obstruction). Having seen the site, a car going south (as the BMW was) at a speed of 45 mph would have been able to stop if there was an obstruction (Toyota) in the roadway when it crested on the little hill about a block north of the intersection.

This would explain why the left front corner of the Toyota seems to have been hit hard.

Horrible. Did the bmw make any attempt to brake? I guess we don’t really know yet, pending the investigation. Wrong place, wrong time. So sad

Police say the Toyota was turning.

“Once the pedestrians cleared the roadway, the driver began turning left. ”

You know when you use ellipses (that’s these three dots…) and repeating the same stupid phrases in multiple posts, we know it’s the same person spamming the board with baseless BS, right?

This was a horrible PREVENTABLE tragedy. There are no winners.

Moral:
- don’t speed too much
- don’t turn in front of oncoming traffic

Every time you post, I am more convinced the BMW driver needs serious prison time. He deserves to fry but unfortunately that’s not an option.

But when someone breaks the rules like Right Of Way, Red Lights, that is where accidents happen. The Toyota guy waited for girls to cross the walkway....every one would have waited. This doesn't make him or anyone a saint.... But, he should have also waited for the incoming traffic with right of way. If this negligence caused the accident, think about it...the car could have rammed into the pavement even at the speed of 40, which would be acceptable...

Gotta love America where the only acceptable laws to break are when you're inside a half-ton death machine.

BMW driver should go to jail. Has he been arrested?

Everyone is blaming this on speeding alone. We should look at the drug angle too. Maybe the driver was impaired. Legitimate question not trolling

“MY speed, while wrong” ?!?!?!

If the BMW driver is actually on here, take some free legal advice. You are admitting you were speeding. You are admitting that it played a role in two deaths. That’s the ballgame. I find it hard to believe your parents haven’t hired an attorney who has told you this, but STOP TALKING, STOP POSTING and GET OFF DCUM. In fact, GET OFF THE INTERNET. Don’t text the nitwits in the car with you. Don’t assume snapchats are gone. The internet is forever, and Jeff says he cooperates with law enforcement warrants, as he is legally bound to do. The ones the police who knock on his door because they have come to get the metadata from your post. BE SILENT and LISTEN TO YOU LAWYER. Unless the accident reconstruction is very different than eyewitness accounts, you are headed to jail. But 3,5,10, 20 years? That’s TBD. All you are doing is making it easier to prosecute you by confessing on a public message board.

If you are indeed the driver, then pointing this— from your home IP, I bet, is about as stupid as driving 100 mph. And I have too say, as the parent of once upon a time walkers on Blake Lane, I hope you rot in jail for a long, long time. And I am sending a tip to the FFX police these messages exist. But I also have a college aged son, so you get 5 minutes of free legal advice. Take it or leave it (I suspect the later). But I would want someone to say this to my kid if they ever did something so unbelievably reckless and stupid and destroyed their lives.

You have the right to remain silent. FFS— remain silent!.

You are irrational. The BMW driver isn’t posting on DCUM. Chill.

I’ve seen a lot of accidents at this intersection. Many cars make u-turns to get to the preschool. Usually the cars are still in the intersection after the crash. This was different.

I think BMW had one or more:
- excessive, reckless speed
- impaired and/or distracted driving
- pushed gas instead of brake, perhaps as airbag deployed
- attempted to hit and run

I hope the driver was questioned immediately (before lawyering up) and was tested for substances. I hope the passengers were also immediately questioned. Where were they going? Why so fast? Yes, there is speeding everyday there but witnesses said it was extremely high rates of speed.
