People speed all the time. Just watch on any road...that doesn't result in accidents...deaths. But when someone breaks the rules like Right Of Way, Red Lights, that is where accidents happen. The Toyota guy waited for girls to cross the walkway....every one would have waited. This doesn't make him or anyone a saint.... But, he should have also waited for the incoming traffic with right of way. If this negligence caused the accident, think about it...the car could have rammed into the pavement even at the speed of 40, which would be acceptable...

Most likely the Toyota was not moving at the time. So the moving vehicle is responsible to avoid the accident which was not possible due to speed. Arriving at a reasonable speed would have allowed that car to brake in time.

The Toyota did wait for incoming traffic. The incoming traffic just happened to be driving light a crazy person at 65mph+ and basically crashed into Everything on the south side of Five Oaks. And I mean EVERYTHING.

How do you know that Toyota waited? If the accident happened in right most lane, then Toyota moved

Maybe the light turned yellow so the Toyota driver saw this as his time to turn, already being out in the intersection, and the BMW driver accelerated to make the light.

Because the approach to that intersection has limited line of sight up Blake Lane due to a slight hill. A car approaching at a reasonable speed, even if still a little over the limit, from the direction the BMW did would have allowed ample time for the 4Runner to turn, but a car coming over that rise at 80+ MPH is a different story. Nobody would see that until it was too late.

Huh. Cute. No, because the excessive speed of the BMW once it turned onto Blake Lane from Sutton and the fact that the BMW probably wasn't even ON Blake Lane when the Toyota first paused to turn left. But you knew that's what I meant...

We are all just speculating here based on what's been released so far, but one thing we do know is that the BMW was traveling at a pretty good clip into that intersection. If the Toyota simply turned into the intersection in front of the BMW, then why wasn't the right front of the Toyota pushed in instead or why wasn't the right passenger side of it t-boned? Why wasn't the BMW crushed in from the front as a result of a high speed impact to a card passing right in front of it? You don't exactly have to be an accident reconstruction expert to draw a conclusion from that.

Again (and again), no charges have yet been filed. But looking at what has been described -
1) The Toyota was making a left and yielded to the pedestrians crossing who have the right of way.
2) In stopping to let the pedestrians cross, the Toyota may have blocked oncoming traffic.
3) Only the BMW hit the Toyota, so there did not seem to be any other oncoming traffic that was impacted.
4) If the BMW was speeding, the Toyota likely started the turn while the intersection/road was clear.
5) If the BMW was speeding, the driver loses the ability to claim the Toyota caused the accident as per Virginia law.

I'm having a hard time imagining that no one else here has ever been in a similar situation - you start making a left turn while the opposing traffic is clear, and then need to yield to crossing pedestrians that have the right of way. Heck, it happens to me when I'm turning into my driveway! Anyway, the charges should tell the story.


This is bad practice. You should always look, and use your judgement to determine if the pedestrians would cross. If in doubt, wait in your lane or at least in a manner that doesn’t obstruct the other lane, and only make the turn when it’s clear. In no situation would this waiting in the middle of the road right. I’m not a HS kid, I live here, drive on Blake ln every day and have seen people who stood in the middle of the road to make their left turn. Was almost Tboned by one on a very visible stretch of road. Both me and the people on the other direction had to slam the brake because we we all surprised that the driver behave so unexpectedly. Stupid judgement on her part!
