And if grandpa did pick her up on purpose should he be prosecuted? To what end? The man is going to live with guilt for the rest of his life, which may not be long. I could see an older person just wasting away after something like this. The heartbreak might kill him. He isn’t a danger to society. It doesn’t sound like he has a rap sheet of killing small kids. What would arresting him do?

This should stay a civil law matter between the family and the cruise line.


A) Neither of us said he should be arrested.

B) The whole point is there isn't a civil case at all. The family is blaming the cruise line when its the guardian's negligence at fault. They should get the body and go home quietly.


I think based on the multiple opinions on this thread alone, there is an open question as to whether the cruise ship met its duty of care. Even if found liable, this will hardly bankrupt the cruise line, but it may inspire them to improve safety measures. At the very least this is more than just a frivolous lawsuit. I know I have a lot of questions about the window height, common practices re: cruise ship window openings, proximity of the children's Play area, window tint coloring, etc., which are reasonable for litigation discovery.


The window height and proximity to the kids area aren't remotely reasonable. If the child had wandered over they would be - but she didn't. She was picked up and placed on the railing.

You are essentially trying to make the argument that the cruise line didn't meet its duty of care in this case because another accident might have happened (but didn't) and it wouldn;t have met the duty of care in that case, had the accident happened (which it didn't).

Go back to doc review, please.

Sadly, that guy has zero credibility.

I've been on this ship recently & the area she fell from was definitely NOT a children's play area, it's a general open area to meet up, eat & drink, complete with a bar, chairs, tables, etc.

Due to the extremly heavy foot traffic in this area, this is probably one of the LAST areas on the ship that I'd want my kids playing in.

Think the Lido deck on the Love Boat.

Those pictures were taken when it was dark outside so the tinted glass of the closed windows is not obvious. The accident happened during the late afternoon when the sun was still up so the tinted windows would be much more obvious.



Or maybe it wasn’t obvious. Ugh. Just watched the video linked above. I didn’t even see the open window. My heart aches for this family. I cannot imagine attacking them right now. Just let it play out. It will likely settle quietly out of court.

I think the baby noticed the open window and pointed at it. Grandpa, not thinking, lifted her up there and out she went.

The fact the family is suing shows how horrible they are. Who uses this opportunity to try to get money? I hope the cruise ship counter sues big time. I’m sure this was an upsetting event for many and could have been prevented.

I doubt that the family contacted this lawyer, he probably contacted them. They are all reeling with grief and are simply trying to navigate themselves through this hellish and unthinkable tragedy.

I doubt that they are the ones pushing for a settlement. The lawyer is representing them and trying to get whatever they might be entitled to.

RC might give them money to make them go away but the cruise line is not an American company. Laws in the Caribbean can be pretty lax. Add to that the video which is probably fairly straightforward and I don’t think this is a case with a lot of money. The lawyer is so bad I wonder if he actually works for RC.

Maybe that’s the idea of blaming the cruise line. If it’s not Grandpa’s fault, she can forgive him.

A friend’s son lost a couple fingers on Grandpa’s table saw in an unlocked shed. Eventually, the family blamed the dog (!) for distracting Grandpa who left the saw running and the shed open. They got rid of the dog and moved on. It was surreal.

Honestly, in this case it's either something like that to blame the ship or the grandfather will end up killing himself.
