I doubt that the family contacted this lawyer, he probably contacted them. They are all reeling with grief and are simply trying to navigate themselves through this hellish and unthinkable tragedy.

I doubt that they are the ones pushing for a settlement. The lawyer is representing them and trying to get whatever they might be entitled to.

They’re entitled to nothing.
They retained the lawyer and can easily stop his shameless money grab.
They’re not placing the blame and accountability on the right party.

Anybody with an ounce of dignity and self respect would grieve in private and move on as best they can.

Completely agree. I will admit anonymously that I do judge the family, harshly. They agreed to attempted litigation and a shakedown before writing the obit. Totally repulsive and if they weren’t a “nice” white Midwestern family with LEO in the family they would’ve getting openly roasted in many venues. And most of those who are honest know it.

Don't judge them too harshly. I would imagine that they were crushed, distraught, destroyed beyond reason by this and this lawyer swooped in an offered them sympathy, compassion and told them which dotted line to sign on.

They didn't seek him out, he came to them. The idea that this family was sitting around with this lawyer strategically figuring out how to really stick to RC is ridiculous.

Still, they could disengage with him once they saw his true colors.

The family experienced something very traumatic. They not only lost a daughter but watched her die and saw her smashed little body. They were in a foreign country and going through a horrific life experience. It is normal to not think clearly and to want to find a reason or explanation other than grandpa just dropped baby out the window. Their minds are trying to rationalize this and make it make sense and what helps is to think that something was wrong that made this tragedy possible. They are traumatized and grieving. An opportunistic lawyer reaches out and convinces them that there is a reason, that it isn't all grandpa and in that moment they cling to that, a glimmer of something.

I don't judge them. My sane rational mind is a million miles away from where their minds are.

They were in Puerto Rico, part of the US FFS. Please get off the DCUM and open Google maps.

In too deep now. People have already started questioning WTH was going on Grandpa. They will defend the lawyer’s account at all costs.

It was stated that the family retained the lawyer to correct misinformation in the media about how the accident happened. They wanted it put out there that the grandfather wasn’t dangling the toddler purposefully out the window. He admittedly let go of her for a moment, perhaps consistent with believing that they were in front of a closed window. The lawyer’s primary role right now has been to interact with the media and request video from the ship. No suit has been filed and no money demanded.

Maybe. Or another passenger opened the window and left it open. I'm sure the security camera footage will show how the window got open.

I do think that it was obvious that the window was open, though, regardless of who actually opened it.

This video shows the windows shortly after the accident (first few seconds of the video, Taken by the dad). There are a few more pictures throughout the video. It isn't really obvious from these pics.

Those pictures were taken when it was dark outside so the tinted glass of the closed windows is not obvious. The accident happened during the late afternoon when the sun was still up so the tinted windows would be much more obvious.

Or maybe it wasn’t obvious. Ugh. Just watched the video linked above. I didn’t even see the open window. My heart aches for this family. I cannot imagine attacking them right now. Just let it play out. It will likely settle quietly out of court.

Nobody is attacking the family. The lawyer is the one coming out with these misleading statements. He's fishing for a settlement and no doubt wants his share of it.

Common sense says that tinted windows are more visible during daylight than pitch black night. That is a fact and basic common knowledge.

How many times have you posted on this thread I wonder?

Fact is I saw the video and I couldn’t see the open window. That’s scary. I don’t think a grandfather just throws a baby over the side of a boat so I’m thinking there might have been some kind of illusion. That’s all.

Sorry, you're wrong.
As I mentioned a few posts up, I was on this very ship recently & it's VERY ready to determine which windows are open and which windows are not, based on the tinting. The tinting goes every other window, which means that only every other window opens, the others never open.

Regardless of the fact that when you stand in front of these windows there's no way NOT to know they were open, because the salted air breeze is so strong it feels like a fan is blowing on high in front of you.

The fact is, you're basing your opinion from a video you saw just a few short snippets of, but I'm here to tell you that short of the grandfather being blind or drunk, it would be absolutely impossible for him not to know this window was open.

There is NO illusion, accidents sometimes just happen.

They just flew back home with their dead daughter's body and buried her. Maybe give these poor people a chance to grieve their baby first before you expect them to address their scumbag lawyer.

Because they want to make sure there is a question first. If there is no question what happened, of course the family won't go forward with a suit.

Stop being pedantic. You know what I mean. It has a completely different culture, language, health care system, and is an island in the Caribbean. It has its own flag and it's athletes compete as Puerto Ricans. The populace calls themselves Puerto Ricans not Americans. Yes it is an unincorporated territory but it is very foreign compared to the 50 states.

Sorry, this should have said:

* it's VERY easy to determine which windows are open and which windows are not based on the tinting.

NP. Holy crap. Just stop talking, you're not doing yourself any favors with your xenophobic comments about Puerto Rico.

Because you know, states don't have different flags, their own cultures, own health care rules, and no states are islands. You are a complete and utter dumbass.

I am not trying to be harsh or out of line, because there is no denying this tremendous loss, and maybe this is their way of dealing with it, but I thought the obit might be a little too much?

Was there an attempt to save the child? Either by the family or cruise staff?
What is the procedure on cruise ships when a person falls in the water?
Especially since this happened while docked.

She fell 11 storys onto concrete as I understand it. I'm sure they did everything they knew how to do for her. But it was not a survivable situation.

That is awful, absolutely awful.
Grandpa should be investigated. This level of negligence is criminal or demented.

Her obituary was beautiful and totally heartbreaking. I felt like I knew that little girl and her family after I read it. I don't know who wrote the tribute but they did a wonderful job and, no, under the circumstances I don't think that it was too much at all.
