If you read my statement as carefully as you should, I by no means claim to have seen the accident and very clearly make a general statement about these kinds of situations. Even turning "always" into "usually", you'll see that my claim stands because "reasonably cautious" means pretty much all the things I state above, including a kid or a ball rolling or darting out from between two parked cars. The driver's attention - especially near schools (this one is marked in all directions!) - and speed needs to be focused on and adjusted to such eventualities.

That said I have no idea what happened in this incident but what you said as the law, isn't actually "the law" (unless you are a personal injury lawyer).

DC is a comparative fault jurisdiction....You can swing into the DC court and sit in on these trials. Very tragic and the sides trying to argue that a pedestrian was a foot outside the crosswalk and therefore the driver is not at fault.

So true! One ran a red light and sped in front of me crossing in the crosswalk through 4 lanes of traffic while I was with a stroller.

Let's stop debating the traffic laws. A child was hit at an intersection right after school exactly where drivers have long been known to flout speed limits and even blow through lights and stop signs. The vast majority of kids on the Hill are either accompanied by adults or trained very well to cross with the light. The traffic situation on Constitution needs to be fixed.

In response to complaints about the traffic on our street, Charles Allen asked for more patrol cars. We are in the Maury district. I've yet to see a single one. Yet another failure on his part.

MOTH reports that she's in the Children's PICU in critical but stable condition. Broken pelvis and shoulder (and, I believe, also leg from what I'd heard earlier) and internal bleeding.

She's 11. Her mom is an aftercare teacher at Maury and she was walking to meet her when it happened. So, her mom was on the scene pretty quickly (someone ran to find her), but not there when it happened. I'm not sure whether they actually live on the Hill (no one on MOTH has chimed in to say that they know them personally/outside of the school, so my guess is that they don't); people have reached out to MOTH to ask if there is a GoFundMe set up/or fundraising needs that need to be met and the person who provided the update said they would check back.
