I am not that PP, but , at the very least, what he should have done is offer her money to live on so that she is not on the government dole.

Well, that doesn't solve the problem that that other poster had, which was that the woman was living in the US illegally.

Offering her money to support her would only be assisting her in the (non-criminal) illegal activity. So I don't think he could have done that.

I don't understand how the crime of being here illegally is not considered a crime by you. Sure she hasn't directly robbed anyone, but she has stolen, milked the system, and not followed the laws. As someone with an immigrant family, and with a family member with a security clearance, I can bet the checks that have been done on him have turned her up. Good on the person who has leaked this information too. I was still undecided.

Under Title 8 Section 1325 of the U.S. Code, "Improper Entry by Alien," any citizen of any country other than the United States who:

Enters or attempts to enter the United States at any time or place other than as designated by immigration officers; or

Eludes examination or inspection by immigration officers; or

Attempts to enter or obtains entry to the United States by a willfully false or misleading representation or the willful concealment of a material fact;
has committed a federal crime.

Violations are punishable by criminal fines and imprisonment for up to six months. Repeat offenses can bring up to two years in prison. Additional civil fines may be imposed at the discretion of immigration judges, but civil fines do not negate the criminal sanctions or nature of the offense.

I have half-aunts I couldn't even identify in a line-up
probably half-uncles, too...

If you are 16:05, why does that housing have to be allocated to African Americans? Would it not have been open to be used by all races?

Also, the person who talks about legality, did you smoke pot as a teen, or have you used one of these "illegals" to cut your lawn?
Yes there are laws that should be respected, but this in no way affects my opinion of Mr. Obama.

I'm no immigratin law expert, but I was basing my understanding from this report I read:

They said here:

http://www.reuters.com/article/wtMostRead/idUSTRE4A01FC20081101

The Associated Press attributed its story to two unnamed sources, one a federal law enforcement official, but said it could not establish whether anyone at a political level in the Bush administration or the McCain campaign had been involved in its release.

It said Onyango's failure to leave the country would be an administrative, non-criminal violation of immigration law. Such cases are handled outside the criminal court system.

PP you quoted: Title 8 Section 1325 of the U.S. Code, "Improper Entry by Alien," but the woman in question apparently entered the US legally; however, she overstayed her visa, when her request for asylum was denied. As far as I can tell, overstaying your visa is not considered a criminal act, but a non-criminal, adminitrative violation, which, because it is non-criminal, is handled outside the criminal court system.

As far as a secuirity clearance goes -- has anyone here had one of these? How far into your family tree do they look into? Siblings? Half siblings? Cousins? Do they check into your half cousins? Half aunts? Step-Grandmothers? There must be some official policy.

Seems to me a half-aunt that you seldom socialize with wouldn't be high on the list to check... but again I'm no expert.

Onyango's refusal to leave the country would represent an administrative, noncriminal violation of immigration law, meaning such cases are handled outside the criminal court system. Estimates vary, but many experts believe there are more than 10 million such immigrants in the U.S.

Is there any information on why this woman was seeking asylum?

When you're running for POTUS they look into everything. EVERYTHING.

Dennis Kucinich would state that there are no illegal aunts.

really-addresses the issues????

all he does is make excuses for Obama-

how is that addressing the issues-he just flames people

ok-his aunt is here illegally-he's mad b/c it was leaked to the press

and all of you are making excuses......

1. Jeff does quite a good bringing information with sources to these discussions. So your comment about excuses is factually incorrect.
2. The only person who is mad is you. This is not an issue, even to the McCain campaign, who dismissed this as "a family matter" just yesterday.
3. You have brought nothing to this discussion except your anger.

Many asylum seekers make up bogus excuses. I did not say ALL asylum seekers.

Nor did you say THIS woman was making up a bogus excuse. Thus, your answer added zero information to the discussion.

It did add something, it planted a thought.

Well, this aunt appears in Dreams From My Father and she attended his Senate swearing-in, so I think Obama can probably identify her in a lineup! But it was a no-win situation for him. He probably knew her visa had expired and she had been denied asylum, but what was he going to do? If he intervened for her that would become an issue. If he said she should return to Africa, that would become an issue. His best bet was probably to do nothing and hope the situation didn't come to light. And even though it has come to light, it's not going to affect the outcome of the election.
