Agreed. The City can argue that the teacher's injuries are just like she slipped on a banana peel and covered by workers comp, but I suspect that won't go over so well. They will settle. |

I know you want that to be true but it isn’t. Workers comp is for all injuries that occur in the course and scope of employment. Even those caused by gross negligence. And even those caused by willful misconduct unless the employer intended to hurt you. Like rape. |
Of course. But that doesn’t matter. Fault is not part of the consideration. Here’s the rub though. If the teacher pursues through the civil system and it takes a long time to resolve, she could be time barred for comp. And if that happened her only recovery would be to sue her employer. Of course she could sue the family but that’s getting her nothing. |
