Not to be too particular, but he was not found liable for rape. Even a New York jury didn't believe her rape claim. He was found liable for "sexual abuse." So as much as she won part of the case, she lost on the part that people are running with--rape. |
I am not a lawyer but it has been noted many times that in New York the legal definition of rape is penile penetration. He penetrated her with him grubby little fingers and he was guilty of sexual battery. In my humble opinion, however, if a man penetrated me with his fingers, I would call it rape as would most women. |

I’ve served as a juror in both criminal and civil cases. You cannot infer what the jury believes. You can only infer that there was not unanimous agreement that the burden of proof was met on that particular charge. When I was a juror in a criminal trial, every single one of us believed that the defendant was guilty, but we followed the judge’s instructions and disregarded improper testimony and found the defendant not guilty because the arresting officer, a rookie making his first solo arrest, screwed up so badly procedurally that the prosecution couldn’t meet the burden of proof beyond reasonable doubt. There may very well be some jurors who believe Trump raped Carroll, but there are negotiations and compromises to reach unanimous verdicts. |

This is the "deplorables" argument, and guess what, Hillary lost using that terrible strategy. His voters are in pain, many of them. They feel wronged. Their nice middle-class jobs went to China, and they are left working three crappy jobs and barely making ends meet. Their savior, That Orange Blob, comes along and validates their feelings. Those foreigners took their jobs, those liberals want to take their guns, which protect them from those Black criminals who are coming to get them, etc. etc. These are feelings, not facts, but the O.B. appeals to their emotions, not to their reasonable minds. And in a fight between emotion and reason, emotion will win in people who are not educated or disciplined enough to tame their emotions in the face of rational facts. I don't think the O.B. is a joke. He's very dangerous. People like you who refuse to acknowledge that his voters have legitimate grievances based, perhaps, on feelings, not facts, are going to drive away the voters who might vote for Biden if they feel the Democrats are listening to them and hear their problems, even if the Democrats don't agree with their views. People need to feel heard, not called deplorable. They are not deplorable, they are weak. Demagogues like the O.B. give these people hope. They want to believe his lies, and he's extraordinarily successful at connecting with these people. Do not underestimate him. He and his voters are extremely dangerous to democracy. |
