Hearsay: and out of court statement offered to prove the truth of the matter asserted.
There are several exceptions (maybe 13) and four exemptions. That’s all I remember from Evidence. |

| I think Heard's attorney is terrible. She's giving Depp's team a lot of unnecessary leeway and not objecting enough to issues of hearsay and relevance. Depp is painting a rosy picture of himself and she's letting him when she doesn't have to let him drone on with irrelevant stories about himself. |
I suppose you could also argue though, that by letting him ramble on, clearly losing the plot at points, you demonstrate to the jury that he’s clearly somewhat of an addled mind, probably from serious abuse of drugs and alcohol. What some see as him painting a rosy picture of himself, others see as him looking out-of-it, and utterly ridiculous as he puffs up his former career. |
The only one who was able to resurrect his career was Robert Downey Jr. and it was only because Mel Gibson paid Downey's insurance bond in 2003. He also didn't make a scene like this clown in court. |

As PP said, it’s an out of court statement offered for the truth of the matter. It’s odd to me that this would be offered for the truth of whatever the lawyer said, though. I didn’t hear the testimony so I don’t know what it was offered for, but I would think it would be to prove Johnny’s state of mind (eg I didn’t call the cops on her because my lawyer said the police wouldn’t do anything”— not offered to prove that the police wouldn’t do anything but offered t show why Johnny did what he diid.) |

I’m not a big Johnny depo fan—liked him in some things, not in others. But this is making me feel so bad for him.
One of my brothers who is a really nice guy fell for a woman who was basically a con artist — I wasn’t crazy about her to start but didn’t realize how awful she was (just found her kind of fake and stupid). But at least she wasn’t abusive like amber and my brother didn’t have an underlying addiction problem to trigger. He got out but it was rough and there was a point at which it seemed like she was going to make up some abuse allegations if he didn’t cave on some stuff. He has paid her so much alimony and child support (even though she never has the kids) but at least he is free. I guess they wouldn’t put me on the jury! |
So even if he says “in his opinion he understood his lawyers to say xyz”. This is still hearsay? Here is what he actually said “The advice I was given was to not fight it,” he testified. |
