Lively/Baldoni Lawsuit Part 2

Anonymous wrote:It is still all over the place and the accounts do not match. We have Blake’s deposition, but I’ve also read the make up artist’s account and it sounded nothing like Blake.

The makeup artist said Heath was knocking on the door and three women yelled “don’t come in! Don’t come in!” And he came in. That is not what Blake said in her deposition at all.

Blake's deposition: "I don't know if it was unlocked at that point. He attempted to come in and we stopped him from coming in." And then, "He unexpectedly came to my trailer, knocked on the door, said, "We've got to talk." I said, "We can't talk right now. I'll be there in a few minutes. I'm getting done as fast as I can so we can have this meeting." He said, "Oh, no, we've got to talk now" --"

Vivian Baker deposition: "I -- I -- I think there was a knock. The -- what I remember most specifically is all three of us. So there must have been a knock, saying, "No, don't come in," and, "No, don't come in." It was quite loud. So that they wouldn't come in. It was myself, Anne, and all Blake saying it at the same time." And then, "After they opened the door, we all saw that it was Jamey. And there was a -- and Blake said -- I don't remember exactly what he said, but I remember her saying, "I'll talk to you about this later." Like, "Let me -- go ahead and move on. I'll get dressed. We'll talk about it later." And I think he said something to the tune of, "No, we'll do it now.""

Shelley Ann Carroll deposition:
Q You stated that you, Ms. Lively, and Ms. Baker verbally indicated something to the effect
of whoa, whoa whoa when Mr. Heath was opening the door; is that right?
A Yes.
Q And did you, Ms. Lively, Ms. Baker give a loud verbal indication that the trailer was occupied at that point in time?
A I believe we were speaking loudly.
...
Q And did Mr. Heath nevertheless open the door to the hair and makeup trailer?
A Yes.

Consistent.

This was something Wayfarer put in that timeline document early on -- it is their characterization of how Lively later described the incident when she discussed it with Heath and Baldoni. They claim she said she knew he wasn't trying to "cop a look." But Blake never testified to saying that. She has consistently said that she told him not to come in and then when he insisted, asked him to look at the wall, and then he looked at her anyway.

They specifically brought up that quote at oral argument so they have something more than recollection. They probably recorded the conversation where she said it. Jamie Heath recorded pretty much everything.

He testified he rarely recorded anything but a handful of phone calls he turned over in discovery.

Again, the WF lawyers are relying on some piece of evidence when making the representation to the Court. Blake has been found to be lying with respect to pretty much all of her allegations, so not surprising this is another one.

You can't even point to a court transcript saying they made that representation in court. What is your evidence this was even raised in court? Some tweet with a summary of oral arguments?

And no, there is zero evidence that they are relying on "some piece of evidence" (that for mysterious reasons has not been listed in any of the pleadings thus far nor unsealed) when they say stuff like this. That comment originally came from the timeline Wayfarer put together early in the case. It has not been corroborated and Blake certainly didn't testify to.

This is increasingly embarrassing for the Baldoni Bro.

Well, you posted the entire oral argument transcript posted on Twitter word for word in this thread and it’s very clearly there.

No, [expletive redacted for manners]. I posted direct quotes from Lively's deposition as recorded by an official court reporter and submitted on the docket, and linked directly to that deposition so you can check to see that I transcribed it correctly. I wasn't quoting a Twitter thread because I'm not a total idiot.

You are the same poster who posted the entire Twitter “transcript” of the oral argument when it occurred, that is pretty obvious. Since you want to pretend you didn’t, you can go back and read it.

I am the person you are currently speaking to you, and no I did not post those tweets in the thread. And I'm not referencing them now. Those tweets are not evidence of anything in this case.

This is not evidence. Someone may have referenced it at oral arguments but we don't have recording or transcript of that -- only second hand accounts from someone in the room. If it was mentioned by Wayfarer's attorney, this is no different from them asserting it in their timeline. And there is nothing on the docket or in any of the pleadings to indicate that Heath recorded that conversation with Lively or quoting a recording of her. But on this thread, someone has repeatedly claimed Blake "testified" that Heath was not trying to cop a look.

This is exactly what I'm talking about with pro-Baldoni people just basing their opinion false assertions made on r/ItEndsWithLawsuits or other non-factual sources. Like someone upthread literally said "look at her deposition, she says she invited him in." But when you read the deposition posted upthread, it's very clear that is NOT what she said and that her deposition testimony was consistent both with her complaint AND with the testimony of the makeup artist in her deposition.

I’m a lawyer. If the WF lawyer said a very specific quote twice at summary judgment oral argument, there is admissible evidence to support it. Further, no one on Blake’s team contradicted it, which they would obviously do if she hadn’t said it.

Okay, lawyer. Please point to the court transcript where the WF lawyer specifically quotes Blake in this way, and point to what the lawyer is quoting.

Oh, you can't? Oh you are basing this on a Reddit summary of a Twitter thread about the oral arguments, for which we don't have a transcript or recording? Hmmm. As a lawyer, how useful is that as evidence? Lemme know when you figure it out.

No I am referring to the transcript that one of you Blake Bots copied and pasted into this thread the day of the oral argument.

Not surprising at all that Blake would lie in her deposition when there are multiple allegations in her complaint since revealed to be lies.

And yet people are literally showing you right now that what people on this thread have alleged to have been "revealed" as lies are not lies, and that Lively's deposition testimony and that of other witnesses are corroborating her allegations from her complaint.

I really am starting to think that the Baldoni Bro on this thread is a paid shill because why would anyone go to bat for Baldoni in this way despite clear evidence to the contrary? No one even knew who he was before all this. It makes no sense.

Lady, there is the dance scene, her lies about telling others to unfollow him, her lies about the black panties, her lies about the birthing video, her lies about the circumcision conversation, her lies about Flaa, etc . .

Cite it. Show us the lies. Not a link to a reddit thread or a summary of a tweet. Show us the evidence proving she lied. I want to see it.

Why do you think this thread is 108 pages. Because you keep rehashing the same disproven allegations over and over. It’s all in here lady, start on page one and reread if you must.

These are all different accounts. The makeup artist’s is the most jarring. Blake’s is actually a bit toned down.

I find it odd that Ryan Reynolds would berate Justin about going behind her back asking her trainer her weight, but he doesn’t berate Heath for bursting in her room when she says don’t come in and refusing to leave when she’s undressed? And they’re walking around calling Justin a predator and he should be in jail but he’s not saying anything about this interaction with Heath?

Something is not adding up here. Ryan did not seem to have much distain for Heath in terms of singling him out. It was all directed toward Baldoni in terms of getting him removed from WME,etc.

I really wish I could read the original New York Times article but it’s now behind a pay wall and I’m not a subscriber.

Right. You’re saying it doesn’t make sense because it doesn’t. Just as the texts not referencing Blake feeling harassed or assaulted literally at all makes no sense. I’ve read coverage of different civil suits involving rape and SH and retaliation and the communications always come in and always have contemporaneous corroboration. Here all the chitty chat is mocking Baldoni and Blake pretending she understands hard work with her repeated use of “bake off.”

There is no amount of reporting and being a dumb b by her supporters that will square Blake’s story into a rational one.

Try starting with some of it then. Should be easy, right? Lay out how the evidence disproves one of her claims.

Use actual evidence though. Not reddit is Twitter. Links and quotes.

DP but this is bugging me. People keep using Reddit as if is not a reliable source. I’m not the poster you are referring to, but when I have used Reddit, I mean that I get the actual links to documents there. Official court documents, the depositions, texts submitted to the court and such.

Yes, there is a lot of commenting on Reddit and videos of lawyers like nag doing analysis which is interesting too, but when many of us are referencing something on Reddit are actually meaning that that is how we get the official court documents.

There are some very diligent posters on Reddit who have organized the court documents very nicely and linked to them so people can follow the case closely. I just don’t think we should be dismissing that.
