No it's not. The words in the Op Ed are what is referred to in the law as "defamatory per se." He only has to prove the elements of defamation, not damages. Damages are presumed if the jury finds that Depp proved the elements of defamation. Therefore, he doesn't have to prove that the Op Ed caused a decline in his career.

This is not true, in the US you have to prove material harm came from the defamation, and the standard is VERY high for a public figure

Not the person you are responding to here, but I personally don’t think that spitting at staff, sh*tting in your spouse’s bed, and lying about donating money to a children’s hospital for her own gain/public image falls within the definition of someone who is simply “not being perfect like Betty Crocker.” Heard has serious issues; she is vulgar and has real anger issues, and her behavior is frightening and bizarre.

I’m also the person who observed that Depp is a mildly brain-damaged drunk, so I’m not critical of Heard in favour of Depp. They are both disgusting people.

During the court proceedings, I just found JD more believable. With his slurred speech and stuttering and his unwillingness to look at her, he was able to bring out a vulnerable side that is often associated with an abused person. By contrast, AH displayed confidence (sometimes too much) and her tears didn't seem very genuine. She sure didn't give me the vibes of an abused person. Maybe both of them were coached to act the way they did. I just think JD performed better, maybe he was just the better actor.
