No it would not be unconstitutional. Freedom of speech is not absolute and we already have plenty of restrictions based on the harm principle. We should treat victims and loved ones of such tragedies with dignity. No news outlet should release names of victims until they have been released by the appropriate authorities. It's that simple.

I don't think this is the type of harm that warrants invoking the harm principle.

yeah it’s all terrible like a person having a metastatic cancer and also a broken nail. nobody wants a broken nail but it’s a really minor thing in comparison yet somehow the focus of the DCUM discussion.

You are really dense. Breaking such tragic news requires particular care because the reaction can be extreme. I had a relative experience the death of a teenage child, and the mother had to be sedated almost immediately, the pain is too much to bear.

You crazies are suggesting censoring the media until they get some sort of signal from LEO that families have you been notified before reporting news. Sounds like a great way for LEO to hide info when they’ve botched things (which we know happens frequently). Also a great way to get this nanny state on a roll. Listen, it is terribly sad for someone to find out about a death from the media, but this was also a freak accident and the the news being exploited is just a residual effect of hanging out with a celebrity.

This appears to be how word spread. News of a helicopter crash in LA. People checked the flight tracker, saw the flight path, googled the tail # and found pictures of Kobe standing beside the copter.

Realistically this is not publically urgent news. Please don't pretend that this effects anyone in the public more than the families of all on board. It's very sad that we feel entitled to this information ASAP when families may not know. This isn't a matter of natuo security. It's tragic and sad, and it's macabre to feel like we have a right to the news before the families whose reality has been shattered.

Depending on how you measure it, helicopters may be 27 times more dangerous than driving - or 85 times. Comparing the rates is tricky.

I did not, one time, say it should be illegal. I said it's a sad commentary on the our entitlement to celebrity lives. And what we value as more important. We love tragedy porn., I'm not immune. I at least don't pretend I'm doing the work of the ACLU to keep from feeling gross about the voyeuristic nature of celebrity tragedies

I suppose a cadre of lawyers and the Supreme court judges must need one too because they seem to hear these cases all the time, and have already posed some limitations.
