This is the problem with hate speech codes. The kids who led this song are despicable and deserve to be expelled but it is not a good thing to expel people selectively -- so I'm not sure they should have been expelled - not because they're innocent but because it's not good for the community overall. And it's clear that activists of various kinds could be accused of hate speech, for example, critics of Israel are sometimes accused of hate speech against Jews -- even though they are criticizing Israel and not Jewish people generally.


The article I posted showed how the comments about Israel did indeed translate to Jews. So there have been problems like that and those students were not expelled. You are correct in what you say above.

African American men/women used to be hanged, tortured and burned alive while white families enjoyed picnic lunches and a festival-like atmosphere.

These OU students were smiling, they were jovial, they were happy..this makes them feel good. This is ok to them.

They are only sorry because they got caught.

I am not sure you guys understand that a public university can make rules that certain types of speech is prohibited on campus or at school sponsored events.

Speech that advocates violence or is likely to incite violence has generally been held not to be protected. If I am OU, I tell them to sue me.


Speech that "advocates" violence is indeed protected. Rather, only speech that constitutes a true threat or is likely to incite imminent illegal action is unprotected. This song does neither. No one was directly threatened, and there is no plausible reading of the facts that this song was an actual incitement to lynching.

A private university could expel them, no questions asked. A state university, however, almost certainly can't. This is not that close a call legally.

Fine. Reinstate them. Now that people on campus know who they are, let them face other students on campus and in class everyday - including AA students. Because your legal analysis may be correct, that their speech is protected. What they are not protected from are some of the other consequences - namely that will likely be viewed a public pariahs by other students and faculty. I think that THOSE consequences will have more impact on them than making them leave. If I were them, I would NOT to go back.

No one can not consider fox a valid news source. There is a disinvestment in Israel movement on college campuses. Outside group have gotten involved and now Israel is a very contentious topic on many colleges campuses. This has manifested into there are no difference between Israel and Jews on one side and the other side sees anyone questioning Israel as antisemitic. Unfortunately it's to the point where neither side is listening to the other side and there is money to be made by stirring the pot...that's where fox comes in. The fox story is very misleading. The students were concern about keeping in place the disinvestment policy against Israel and in support of the Palestinian.

The woman who is the subject of the article was in fact confirmed with a 9-0 vote, which means that all of the people who might have discriminated against her did not deny her the position she was seeking. The student government also unanimously passed an Jewish anti discrimination resolution.

Yes, it does. I am an Asian and should I not care when AA are being targeted?
